Tutors and guardians are entitled to determine, on their own, the methods to be used for raising the children under their tutorship (or guardianship) and to choose the educational facility and the forms of training for a person under their charge until that person receives a basis general education, with the opinions of the children and the recommendations of the tutorship and guardianship authorities taken into account.

A list of diseases that a person has and that prevent him from adopting a child or taking a child under his tutorship (or guardianship) is being compiled by the Government.

Guardianship

The childbirth benefit as a single benefit is granted to one of the parents of the child or a person who has adopted or assumed guardianship over a child under the age of one year.

382. The Family and Guardianship Code specifies cases when another person authorized to exercise parental authority, inter alia in the following situations

(f) Under civil and family law, tutors and guardians are appointed by tutorship and guardianship authorities.

If a parent fails to perform the duty to provide maintenance to a child, a court will, at the request of the other parent, guardian or guardianship authority, order support for the child to be paid to the parent who submitted the claim or to the guardian or person in whose interests the guardianship authority submitted the claim.

Under our legislation, in the event of the mother apos s death the father automatically assumes guardianship of the children, but in the event of the father apos s death guardianship does not pass automatically to the mother there is instead the possibility of appointing someone else as guardian.

Under this law a child is defined as a minor person, i.e. a person from birth until majority.
