D2 (personal injury) and D3 (death) losses

The Panel reviewed 117 claims with D2 (personal injury) or D3 (death) losses.

In support of his claim for D2 (personal injury) losses, the claimant provided medical reports evidencing that he and his two children suffered injuries as a result of a missile attack during Iraq's invasion and occupation of Kuwait.

Individual claimants were given the opportunity to claim for these injuries under the B , C and D claims categories and indeed have done so, claiming for personal injury and death, mental pain and anguish resulting from hostage taking, illegal detention and other similarly traumatic events.

The overall recommended award for D2 (personal injury) and D3 (death) losses is USD 294,619 out of a claimed amount of USD 1,056,667.

Specifically, the secretariat, in valuing the loss of money component of the claimant's D2 (personal injury) claim, made an incorrect deduction with respect to the amount of compensation already awarded to the claimant for the same loss by the E F Panel of Commissioners through a claim filed by the French Government entity responsible for compensating victims of terrorism (Fonds de Garantie Contre les Actes de Terrorisme).

In the view of the Panel, the fact that an injured national can bring an individual claim for a specific injury or damage does not affect the right or standing of a State to bring a national claim, so long as there is no duplication in compensation awarded for the same injury or damage.

The Panel finds that the claimant has failed to prove any direct loss and therefore recommends no award of compensation for D2 (personal injury) losses.

According to Iraq, the rules established by the Governing Council provide for the compensation of claims submitted by individuals for personal injury or mental pain and anguish.

3. Local remedies shall be exhausted where an international claim, or request for a declaratory judgement related to the claim, is brought preponderantly on the basis of an injury to a national or other person referred to in draft article 8.

According to section 1 of chapter 5 of the Finnish Damages and Tort Liability Act of 1974, damages shall constitute compensation for the personal injury and damage to property.

This statistical analysis showed that the loss types with the greatest increases in amounts claimed were D1 (MPA), D1 (departure), D2 (personal injury) and D8 D9 (individual business) losses.

Where there is a reference to a claim number in parenthesis, this reference is to the new claim number created by the E4 Panel after severance of the corporate losses from the personal losses.

The limits also covered contracts of employment, personal injury and damage to property, intellectual and industrial property, participation in companies, and ships owned or operated by a State (arts. 11 to 16).

However, the only medical evidence provided by the claimant to prove his personal injury losses was a medical report dated 23 March 2003 indicating that he had eye surgery to remove cataracts.

After that first injury, their risk for second injury is exponentially greater.

As the report did not identify the cause of the medical condition nor link the condition to the alleged beating and detention, the Panel recommends no award of compensation for D2 (personal injury) losses.

As a result of this clerical error, the Panel recommended no compensation for the claim, which included D1 (mental pain and anguish) and D4 (personal property) losses.

Reparation for injury

In the view of the Panel, there is no provision in the relevant resolutions of the Security Council or decisions of the Governing Council which prevents a government from bringing a claim for a public health loss, damage or injury for which it would be entitled to claim under international law.

While the existence of such conditions may strengthen a complainant's claim, the Committee's jurisprudence establishes that the complainant must adduce additional evidence to show that there is something in his or her personal circumstances which contributes to a personal risk of torture if returned.

4.8 The State party concludes that the complainant has not substantiated his claim that he would risk a foreseeable, real and personal risk of torture if returned to Ecuador.

The Panel notes that largest portion of the claim (USD 70,000,000) is for punitive damages, which are not compensable in principle pursuant to Security Council resolution 687 (1991), which limits compensation to direct loss, damage or injury.

Other delegations expressed support for the Commission's drafting of the continuous nationality rule, which entitled a State to exercise diplomatic protection in respect of a person who was a national at the time of the injury and at the time of the official presentation of the claim, but was no longer a national at the time the claim is settled.

It follows that a Government is entitled to bring a claim for compensation for a loss, damage or injury suffered by it, so long as the claim is in conformity with Security Council resolution 687 (1991) and other relevant Security Council resolutions, the criteria established by the Governing Council for particular categories of claims and other pertinent decisions of the Governing Council.

Children of the insured who due to illness or injury terminated their regular schooling, are entitled to health insurance during illness or injury.

In an accusation for injury, no proof whatsoever of the veracity of the facts to which the injury may refer shall be admissible.

In the original claim file, the claimant submitted limited documentation including a personal statement, handwritten lists of spare parts, 1987 lease contracts for two stores and a rental receipt for each store dated in 1991.

The pattern is especially evident for D1 (mental pain and anguish)( MPA ), D1 (departure), D2 (personal injury) and D8 D9 (individual business) losses The average and median amounts claimed in this instalment are higher than for all claims in the regular category D claims programme.
