16 weeks' pregnancy and maternity leave.

Leave begins during the last two months of pregnancy.

The pregnancy and childbirth leave lasts for 56 calendar days.

Pregnancy and maternity leave cannot influence employment security, because the labour law forbids pregnancy tests on employment, i.e. firing women for the sole reason of their pregnancy and maternity leave is not allowed and it represents a severe offence.

Women who have registered at a medical preventive institution by the 12th week of their pregnancy and which continued during the whole pregnancy period, are granted an additional pregnancy leave of fourteen calendar days, adding it to the pregnancy leave and calculating a total of seventy calendar days.

Women have the right to pregnancy and maternity leave of 140 calendar days.

Pregnancy and maternity leave do not affect the security of employment because the test for pregnancy upon employment is forbidden by law, that is, it is forbidden by law to fire women because of pregnancy and maternity leave since that poses a serious offence.

The Labor Law (1998) protects the workingwomen on issues regarding pregnancy and maternity leave.

Among other things, this Act regulated the payment of benefits to self employed women during pregnancy and maternity leave and adoption leave.

During pregnancy, delivery and childcare, each woman has a right to one year of undisturbed maternity leave.

The Labour Code provides that the pregnancy leave of fifty six calendar days and the childbirth leave of fifty six calendar days, summed together, making a total of one hundred twelve calendar days, irrespective of the number of days of the pregnancy leave that have been used before the childbirth.

The Committee is also concerned that girls and young women are often forced to leave school because of pregnancy.

Some wage earners are entitled to full pay during pregnancy and maternity leave as a result of collective agreements.

A father has the right to be granted additional parental leave of fourteen calendar days during the pregnancy leave or maternity leave of the mother or within two months after the birth of the child.

In the case of multiple births or a delivery with complications, 154 calendar days of pregnancy and maternity leave is given.

The same Article also provides that if the woman has registered with a physician by the 12th week of pregnancy, she is granted an additional paid leave of 14 calendar days, thus the length of the pregnancy leave and the benefit period is extended from 56 to 70 calendar days.

Article 26 of the law on labour in the Republic of Kazakhstan prohibits dismissal on the grounds of pregnancy or maternity leave.

At the time of pregnancy, birth, and childcare, a woman has the right to maternity leave in the duration of one straight year.

Funds for reimbursement of pregnancy leave are provided for in budgets of cantons, or municipalities and Brčko District at levels determined by legislation.

The Employment Standards Act, 2000 (ESA, 2000) extended the length of parental leave from 18 weeks to 35 weeks if the employee also took pregnancy leave, or 37 weeks if the employee did not.

Article 165 of the new Labor Relations Law (Official Gazette No. 62 05) regulates the leave of absence for pregnancy, giving birth and parenthood.

Women have the right to pregnancy and maternity leave of 70 calendar days prior to the expected date of birth determined by the doctor.

The Law also provides that before the pregnancy and childbirth leave or immediately after the leave the woman is granted the annual vacation following her application, irrespective of the length of service with the respective employer.

The mother has the right to 4 weeks of pregnancy leave before the expected date of birth and to 14 weeks of maternity leave after the birth of her child, the first 2 weeks of which are obligatory.

Women who are pregnant, who are on leave due to pregnancy related reasons and who are raising children under 12 months are not subject to labour disciplinary measures.

During the pregnancy and maternity leave, women are paid a compensation for temporary incapacity for work in the amount of 100 of average income per one calendar day.

170. Wage earners absent from work owing to pregnancy or maternity or adoption leave may receive benefits from their municipality of residence from the first day of absence.

Indeed, the young husband could pursue his studies while his wife would most probably have to leave school because of a pregnancy, which was a normal consequence of marriage.
