Third report on responsibility of international organizations

This will be the fourth report on responsibility of international organizations.

The Committee indicated that its main role and responsibility was to report to the General Assembly.

The Panel delivered its report, A more secure world our shared responsibility (A 59 565), in December 2004.

Development is a shared responsibility of the developing and developed countries, and the report makes that very clear.

The report recognized that the primary responsibility for translating the potentialities into actual outcomes rested with the State.

In this context, Poland assesses positively the report of the High level Panel, A more secure world our shared responsibility .

In our view, the two central messages of the report are a reflection of the mutual responsibility and accountability underpinning NEPAD.

The Working Group in its report briefly considered the scope of the topic, the relations between the new project and the draft articles on Responsibility of States for internationally wrongful acts , questions of attribution, issues relating to the responsibility of member States for conduct that is attributed to an international organization, and questions relating to the content of international responsibility, implementation of responsibility and settlement of disputes.

The final report has been compiled in accordance with the Chatham House Rules under the sole responsibility of the Permanent Mission of Finland.

Like the two previous reports, the present report follows the general pattern of the articles on responsibility of States for internationally wrongful acts.

Of course, some of the recommendations made in the report must be further elaborated on, and that responsibility falls to us, the Member States.

As the Secretary General has underlined in his report, the ultimate responsibility for resolving the crisis in Côte d'Ivoire lies with the Ivorian political actors.

The report also accepts the vague and highly controversial concept of responsibility to protect , which has been the subject of a wide range of interpretations.

According to a report submitted by the International Federation for Human Rights on a mission to Japan, it is the defendant's responsibility to bring forth evidence in favour of their defence or to mitigate their responsibility, which is not always possible where defendants have limited means.

The Ministry of Justice, Legislation and Human Rights and the Ministry for the Family, Social Protection and Solidarity had shared responsibility for drafting the report currently before the Committee.

The next report of the Special Rapporteur will address questions relating to (1) circumstances precluding wrongfulness, and (2) responsibility of States for the internationally wrongful acts of international organizations.

Reference was made to the report of the High level Panel on Threats, Challenges and Change, entitled A more secure world our shared responsibility (A 59 565 and Corr.1).

The Secretary General has been especially concerned with addressing the root causes of terrorism, as has his High Level Panel in its report. A More Secure World Our Shared Responsibility.
