In the circumstances, in the Committee's view, the appeal was so intrinsically linked to the purpose of preventing deportation, and hence to the suspension of the deportation order, that it could not be considered an effective remedy if the deportation order was enforced before the appeal concluded.

However, French law allows judges of administrative courts discretion to order a stay of execution of deportation measures or the temporary suspension of their application.
