As the category D Palestinian late claims were not filed until the end of the regular category D work programme, matches between regular and Palestinian category D claims were identified upon review of the latter claims.

Chapters II and III contain recommended corrections concerning claims in category D and category C Palestinian late claims , respectively, where the panels of Commissioners continue their work.

The average number of loss types is 3.14 for the claims in this instalment, compared with 2.01 for all claims in the regular category D claims programme, 1.93 for Jordanian claims and 1.71 for Kuwaiti claims.

The Panel has re examined the claims for the losses of the companies in the light of the two individual claims identified as stand alone claims after the E4A Panel's conclusion of its work on the twenty ninth instalment.

The searches identified 104 E4 claims with approved awards of compensation in the first seven instalments as potentially overlapping with 61 claims in category C and 70 claims in category D .

In addition, the searches identified 287 E4 claims in the remaining E4 instalments as potentially overlapping with 168 claims in category C and 203 claims in category D .

A similar exercise was conducted with respect to category C for the purpose of identifying duplicate claims during claims processing.

A preliminary examination of these claims revealed that some, but not all, of the Kuwaiti companies in issue had filed claims with the Commission, which were being processed as E4 claims.

The median amount claimed is about USD 470,000 for claims in this instalment, compared with about USD 263,000 for all claims, about USD 335,000 for Jordanian claims and about USD 276,000 for Kuwaiti claims in the regular category D claims programme Approximately 75 per cent of the claims in this instalment contain D8 D9 business losses in relation to unincorporated establishments in Kuwait.

With regard to claims for expenses resulting from public health expenditures, Iraq contends that there is no legal basis for such claims.

The UNCC secretariat commented that it has also assisted the D2 Panel of Commissioners in its review of the category D Palestinian late claims, a claims population with a significant risk of overstated claims.

The individual category C and D claims in the thirtieth instalment are claims filed through a late claims programme established by the Governing Council for Palestinians who can demonstrate that they did not have a full and effective opportunity to file claims with the Commission during its filing period for individual claims from 1 January 1992 to 1 January 1996 (the regular filing period for individual claims ).

The Panel reviewed the 17 eligible category C claims in accordance with the relevant evidentiary standard and methodologies for category C Palestinian late claims .

The fourthsecond group of overlapping claims initially consisted of E4 claims related to 39seven category C claims and 24 category C and D claims.

Families of the Paniai victims greeted such claims with grim incredulity.

Other claims with this loss type relate to loss of cash.

With respect to business loss claims, the analysis is more complex.

Before the claims in this instalment were submitted to the Panel, the secretariat undertook a complete review of these claims in accordance with the Rules.

With regard to Iraq's contention that some of the claims are for indirect losses, the Claimants state that these claims are not for indirect losses since, by their very nature, they can only be claims of the State.

Accordingly, all but one of these claims were transferred to the merged E4 Panel of Commissioners for review as stand alone claims in accordance with decision 123.

Chapter I of this report contains recommended corrections concerning claims in categories A and C , where the panels of Commissioners have concluded their work.

In connection with the claims by governments for loss of life and reduced quality of life of their nationals, Iraq asserts that the claims are inadmissible because the Claimants concerned lack legal standing to bring such claims before the Commission.

The total claimed amount with respect to these 404 claims is USD 866,199,856.81.

The Panel reviewed 117 claims with D2 (personal injury) or D3 (death) losses.

Concerning the issue of duplicate claims, the secretariat indicated that it was aware of the risk of duplicate claims from the outset of claims processing and took steps to identify and eliminate such claims during the course of claims processing.

A preliminary examination of these claims also revealed that in some instances the Kuwaiti companies in question had filed separate claims with the Commission, which were being processed as E4 claims. However, there were a number of instances where the Kuwaiti company had not filed a separate claim with the Commission.

10.3 With regard to the author's claims under article 1, the Committee recalls its previous jurisprudence, and notes that such claims are not justiciable under the Optional Protocol.
