170. The Crimes of Torture Act 1989 has specific and directly enforceable provisions to prohibit acts of torture. The definition of act of torture in the Act is in accordance with the relevant definition of article 1 of the Convention.

173. The prohibition against torture contained in the Crimes of Torture Act now is specifically included in the training manuals of prison officers.

The vast majority of officials engaging in torture or ill treatment were said to act with impunity.

That means they have accepted obligations to take effective measures to prevent acts of torture and to ensure that any act of torture is an offence punishable under their criminal law.

However, no person at risk of torture may be refused a residence permit (chapter 3, section 3, of the Act).

Officials of Vanuatu suspected of having committed an act of torture had to face disciplinary action in addition to criminal proceedings.

Almost all countries reported that a law enforcement official who committed an act of torture was punished under national law.

The enforcement of the expulsion order cannot be considered an act of torture within the meaning of article 1 of the Convention and article 2 only applies to acts tantamount to torture within the meaning of article 1.

Officials carrying out torture were said usually to act with impunity, as few investigations of such officials had reportedly been carried out.

254. The Committee urges the State party to review Convention against Torture Act 22 94 and other relevant laws in order to ensure complete compliance with the Convention, in particular in respect of (a) the definition of torture (b) acts that amount to torture and (c) extradition, return and expulsion.

252. The Committee noted that, while the Convention against Torture Act 22 94 covers most of the provisions of the Convention, there were certain significant omissions.

But it is not unrelated to sex. The sexual act is used as a form of torture, or even, in some cases, as a deadly weapon.

After closing Guantánamo Bay and forbidding torture, we must repeal the Patriot Act, thereby restoring the Constitution s restraints against warrantless wiretapping and surveillance.

And that was torture, real torture.

Almost all countries stated that law enforcement officials were never allowed to inflict, instigate or tolerate any act of torture or other cruel, inhuman or degrading treatment or punishment.

141. In the case of Abdul Mageed Khalifa, who allegedly died as a result of torture at al Wasta police station in May 1994, the DPP had decided that a complaint by his family alleging that he had died as a result of a criminal act of torture was inadmissible.

Death by torture 137. There have been serious, substantiated reports of torture, including torture by applying electric current through a baton or club. The information gathered confirms that torture is used systematically.

However, article 14 of the Convention not only recognizes the right to fair and adequate compensation but also imposes on States the duty to guarantee compensation for the victim of an act of torture.
