International investment disputes arising from investment agreements are on the rise, at times involving tens of millions of dollars.

In terms of investment promotion strategies, investment promotion agencies (IPAs) are mainly focused on investors based in developed countries.

The Agreement entered into force on 1 February 2004. Seven States are parties to the Agreement.

Although US and EU tariffs on each other s marketed manufactured goods are already low (below 3 , on average), a free trade agreement would be enormously beneficial in promoting further investment, thereby boosting economic growth and creating more jobs. Such an agreement could include trade in goods, services, financial instruments, and agriculture, and would necessitate greater compatibility of European and American regulations and legal norms, implying substantial savings.

For example, investment in efficient energy production and conservation is being held back by pervasive uncertainty about the future path of climate policies. A European agreement on how to stabilize the price of carbon would help to catalyze private projects.

Regionally funded investment guarantees and non discriminatory region wide tax incentives would also impact favourably on the region's investment climate.

An emphasis on investment shifts the focus of development strategy to the entrepreneurial class and its interaction with the state, including whether and how public investment crowds in private investment.

The real failure was that there was no agreement about how to achieve the lofty goal of saving the planet, no agreement about reductions in carbon emissions, no agreement on how to share the burden, and no agreement on help for developing countries.
