(h) Recognize existing creditors rights and establish clear rules for ranking of priority claims.

(188) The insolvency law should specify that secured claims should be satisfied from the encumbered asset in liquidation or pursuant to a reorganization plan, subject to claims that are superior in priority to the secured claim, if any.

Where the estate is insufficient to cover all the claims within the same priority , then settlement shall be made on a pro rata basis within that priority.

Concerning the issue of duplicate claims, the secretariat indicated that it was aware of the risk of duplicate claims from the outset of claims processing and took steps to identify and eliminate such claims during the course of claims processing.

The law should limit, both in number and amount, preferential claims that have priority over security rights that are effective against third parties, and to the extent preferential claims exist, they should be described in the law in a clear and specific way.

With regard to claims for expenses resulting from public health expenditures, Iraq contends that there is no legal basis for such claims.

Duplicate claims The Commission received information from the Government of Jordan that two claims were potentially duplicative of two other claims that were awarded compensation in category C Having reviewed the information received from the Government of Jordan, the secretariat confirms that the claims are, indeed, duplicates and should not have been awarded compensation.

The individual category C and D claims in the thirtieth instalment are claims filed through a late claims programme established by the Governing Council for Palestinians who can demonstrate that they did not have a full and effective opportunity to file claims with the Commission during its filing period for individual claims from 1 January 1992 to 1 January 1996 (the regular filing period for individual claims ).

The present report sets out the Panel's recommendations for a fourthsecond group of overlapping claims from resolved E4 instalments (the fourthsecond group of overlapping claims ).

With regard to the claims made for pain and suffering for non fatal injuries, the Claimants state that these are distinct from the government claims for reduced quality of life.

Where necessary and appropriate, the Panel requested additional information from the Claimants to clarify their claims.

The average amount claimed for the claims in this instalment is about USD 2 million, compared to about USD 820,000 for all claims, about USD 934,000 for Jordanian claims and about USD 861,000 for Kuwaiti claims in the regular category D claims programme.

Of these claims, the Panel recommends awards of compensation for two claims, while no awards are recommended for the remaining 16 claims.

CLAIMS OF THE ISLAMIC REPUBLIC OF IRAN Overview In the fifth F4 instalment, the Panel reviewed five claims submitted by Iran for compensation for damage resulting from Iraq's invasion and occupation of Kuwait.

8.2 The State party notes that before the Norwegian courts, the authors' claims of exemption from the school subject named Christian Knowledge and Religious and Ethical Education were adjudicated in a single case, along with identical claims from three other sets of parents.

Of the 24 company claims in this instalment, 19 are stand alone claims four are corporate detainee claims and one is an E2 claim.

Iran has neither fully explained the nature of the losses nor distinguished them from other similar losses for which it claims compensation in other claim units of this claim or in its other claims.
