At its thirty fifth session (New York, 17 28 June 2002), the Commission adopted the UNCITRAL Model Law on International Commercial Conciliation.

At its thirty seventh session, in 2004, the United Nations Commission on International Trade Law (the Commission ) entrusted the drafting of proposals for the revision of the 1994 UNCITRAL Model Law on Procurement of Goods, Construction and Services (the Model Law , A 49 17 and Corr.1, annex I) to its Working Group I (Procurement).

As to the form of work, the Commission considered that a model law might be too rigid and noted the suggestions made for a set of principles with a legislative guide that would include, where feasible, model legislative provisions.

Appreciating the efforts that the Commission has made over the years in removing obstacles to electronic commerce in existing laws, notably by enacting the Model Law on Electronic Commerce in 1996 and the Model Law on Electronic Signatures in 2001,

Noting the uncertainty created by that provision, the Commission had subsequently agreed to create more certainty by inserting article 6, paragraph 3, in the UNCITRAL Model Law on Electronic Signatures.
