C. Appointment of members of the Working Group on Communications under the Optional Protocol

(a) That the communications are inadmissible under articles 1 and 2 of the Optional Protocol

Communications submitted under the Optional Protocol shall be examined by the Committee, working group or rapporteur in closed meetings.

It also continued to authorize two annual sessions of the Working Group on Communications under the Optional Protocol to the Convention.

The seventh session of the Working Group on Communications under the Optional Protocol will be held from 9 to 13 January 2006.

The Committee is mandated under the Optional Protocol to the Convention to receive and consider communications from individuals or groups of individuals and to transmit its views with respect to such communications to the parties concerned.

4.2 The State party notes that the Optional Protocol does not include a special time limit for the presentation of communications to the Committee.

The Secretary General shall maintain a permanent register of all communications submitted for consideration by the Committee under article 2 of the Optional Protocol.

ICERD and the OP to CEDAW allow groups of individuals as well as individuals to bring communications. The rules of procedure of the Human Rights Committee allow groups of individuals to bring communications under the Optional Protocol to ICCPR

The working group may wish to consider which approach would be best suited in relation to an optional protocol taking the form of a communications procedure.

Consequently the communication must be considered inadmissible, in accordance with article 3 of the Optional Protocol, as an abuse of the right of submission of communications.

The Committee appointed the following five members to serve on the Working Group on Communications under the Optional Protocol, for a term of two years, until 31 December 2006

Mr. Flinterman welcomed Benin's ratification of the Optional Protocol to the Convention but recalled that communications could be referred to the Committee only when all local remedies had been exhausted.

Accordingly, the Committee concludes that the authors may not consider themselves victims within the meaning of article 1 of the Optional Protocol in respect of the aforementioned complaint and finds this part of the communications submitted by the authors inadmissible in accordance with article 1 of the Optional Protocol.

The Committee therefore concludes that the submission of the communication does not constitute an abuse of the right of submission of communications in the sense of article 3 of the Optional Protocol.

This report shall be prepared each time that the review process under Article 8 of the Kyoto Protocol relating to national communications and supplementary information from Parties included in Annex I is completed.

In 2004, it ratified the Optional Protocol to the Convention on the Elimination of All Forms of Discrimination against Women, thus recognizing the competence of the Committee to consider communications submitted by individuals.

The fifth session of the Working Group on Communications under the Optional Protocol will be held from 31 January to 2 February 2005, and the sixth session from 29 June to 1 July 2005.

It appears to allege that the communication should be considered inadmissible as constituting an abuse of the right to submit communications under article 3 of the Optional Protocol in view of the time elapsed.

Inadmissible communications

The Committee shall hold closed meetings when examining communications under the present Protocol. After examining a communication, the Committee shall forward its suggestions and recommendations, if any, to the State Party concerned and to the petitioner.

The secretariat uses the UNFCCC web site to present consolidated relevant information on existing guidelines, decisions and conclusions relating to the preparation of national communications and reports demonstrating progress made in achieving commitments under the Protocol.

Another promising initiative the optional protocol on communications, aimed at enabling children and their advocates, for the first time, to bring cases before the UN Human Rights Committee has been similarly weakened by a lack of strong support, authority, and resources. Indeed, only 14 countries have ratified the protocol since it was agreed in 2011.

The Committee notes that, in accordance with article 1 of the Optional Protocol, communications must be submitted by or on behalf of individuals who claim that any of their rights enumerated under the Covenant have been violated.

The Secretary General shall bring to the attention of the Committee, in accordance with the present rules, communications that are, or appear to be, submitted for consideration by the Committee under article 2 of the Optional Protocol.
