9. France supported the principle that the court should have jurisdiction over a core of exceptionally serious crimes genocide crimes against humanity and war crimes.

There seemed to be overwhelming support for the inclusion of three core crimes, and the court should have inherent jurisdiction over those crimes.

67. War crimes, crimes against humanity and genocide the core crimes should be under the inherent jurisdiction of the court, as should the crime of aggression, if a proper legal definition could be attained.

Namibia supports the establishment of an international criminal court, with its jurisdiction being limited to hard core crimes crimes of genocide, serious violations of the laws and customs applicable in armed conflict and crimes against humanity.

It was in favour of including the core crimes of genocide, war crimes and crimes against humanity, as well as the crime of aggression if the international community was able to define it in legal terms.

Her delegation was strongly in favour of the court having jurisdiction to consider exceptionally serious crimes, known as core crimes, and had great difficulty understanding how any State becoming a party to the Convention should be in a position to choose the core crimes for which individuals would be answerable to the court.

In that context, his delegation believed that the court s powers should not be circumscribed by those of the Security Council and that it should be allowed to exercise direct jurisdiction over the core crimes.

The jurisdiction of the court should therefore be limited to the core crimes and even then the court should exercise jurisdiction only if the State concerned decided that it was unable to do so.

C. Relationship between international crimes and crimes against international law

Since it is limited to politically motivated crimes, to the exclusion of the crimes of genocide, crimes against humanity and war crimes, the provisional immunity cannot be a bar to investigation into any of those crimes.
