The ever increasing number of persons arrested for drug offences and drug related offences has led to an overloading of many criminal justice systems, resulting in congestion and delay of all types of cases.

Drug treatment courts typically target offenders whose dependency contributes to serious criminal offences such as burglary, property offences, or domestic violence, and, depending on the jurisdiction, drug dealing, who consent to participate in the programme and are deemed suitable to do so.

Only a few States in Europe and in the Americas used such a tool with respect to drug offences.

503. The Special Rapporteur was informed that Turkmenistan retains the death penalty for 14 offences, among them drug trafficking.

Treatment alternatives to imprisonment for persons arrested for offences involving drug possession were also mentioned as an effective approach to reducing the risk of HIV infection and continued drug abuse.

In addition to drug law offences, a series of common crimes, both against the person and against property, are committed as direct or indirect consequences of drug abuse and trafficking.

Singapore also considers certain drug offences as stipulated in the MDA as most serious crimes and thus they attract capital punishment.

In that regard, new legislation had been adopted and penal codes amended to comply with the provisions of the international drug control treaties and facilitate the investigation and prosecuting of drug trafficking offences.

The importance of providing alternatives to imprisonment for minor offences, in accordance with the provisions of the international drug control treaties, was emphasized.

The Special Rapporteur concludes from this, that the death penalty should be eliminated for crimes such as economic crimes and drug related offences.

An interview survey and an analysis of registry data showed that while drug offences ceased almost entirely during the experiment, other crimes increased.

A few States reported, however, that they could not furnish statistics for extradition for drug related offences as their records made no such distinctions.

Twenty per cent of cases are for drug related offences, 20 per cent for prostitution, 40 per cent for theft, and the remaining 20 per cent for offences such as hooliganism, taking liberty with women and disrupting public order.

Many States provided specific information on such units for example, Peru reported that the National Anti Drug Directorate of its National Police had established specialized investigation units covering specific areas of drug trafficking and related offences.

In several States, stricter laws have been adopted against drug related offences, and judicial cooperation is being carried out, especially in the field of extradition.

As noted above, Iranian sources advise that nationally, 63 per cent of about 150,000 prisoners have been convicted of drug related offences (see para. 30 above).

All Federal indictable offences are money laundering predicate offences.
