Money Laundering is a penal offence under the Bhutanese law and chapter 19 of the Penal Code of Bhutan 2004 has provisions to deal with this offence.

Chapter 34 a, section 5 of the Penal Code establishes the financing of terrorism as a criminal offence.

The Committee also encourages the State party to define trafficking as a special criminal offence under the Penal Code.

Article 156, Book II, of the Penal Code provides that Any conspiracy formed with the aim of committing an offence against persons or property constitutes an offence consisting of the sole act of organizing the group .

The abovementioned provisions must be read in conjunction with the Penal Code Sections 147 a, which makes it a serious criminal offence to commit a terrorist act, and 147 b, which makes it a serious criminal offence to finance terrorism.

Under Chapter 34 a, section 5 of the Penal Code, the financing of terrorism is punishable irrespective of whether the terrorist offence is committed or not.

However, as provided in Chapter 34 a, section 5(4) of the Penal Code, the penal provisions on the financing of terrorism do not apply if an act is punishable as an offence referred to in paragraph 1, subparagraphs 1 to 5 or as an offence provided for in section 1 or 2 of Chapter 34 a, or as an attempt to commit any of such offences, or if it is punishable as complicity in such an offence.

It will also cover penalty on legal persons, typification of terrorist financing and concealment of terrorist assets as individual offence as well as specific procedures for penal prosecution.

Although Estonia does not have special legal acts against trafficking in human beings, such activity is covered as a criminal offence by several provisions in the Penal Code.

The Prosecution advocates a broad interpretation of section 203A of the Penal Law (the trafficking offence) in court and lobbied for stringent sanctions against traffickers, including compensation for victims.

The Penal Code of Burkina Faso accordingly criminalized the existence of an organized criminal group as a separate offence, before the commission of any act that was the subject of the agreement.

As mentioned in our first report, Section 153 a of the Penal Code makes it an offence to develop, produce, store or otherwise obtain or possess bacteriological or other biological substances and toxins.

Article 5 of the new draft Penal Code states that the Code applies to any person who commits an offence, even abroad, whenever the conditions set out in the following paragraphs are met

It should also be pointed out that the Penal Code allowed for the extension of the prosecution of members of an organized group to persons outside the group who had participated in the commission of an offence by the group, as associates or accomplices (arts. 64 and 65 of the Penal Code).

With regard to corruption, whose criminalization had been recommended by the Convention, the Penal Code of Burkina Faso, in articles 156 and 160, defined and imposed penalties for the commission of such an offence.

Indeed, failure to pay alimony was an indictable offence under the Penal Code, while under civil law, the assets of a father who failed to pay child support could be confiscated to enforce such payment.

The aforementioned provision of the Penal Code means that the financing of terrorism may, taken as a whole, constitute such an essential part of an offence under section 1 (offences made with terrorist attempt) or section 2 (preparation of an offence to be committed with terrorist intent) that the financier may be punished as an accomplice.

According to Chapter 46, sections 1 3 of the Penal Code, a person who violates or attempts to violate a regulatory provision of a sanctions regulation shall be sentenced for a regulation offence to a fine or imprisonment for at most four years.
