C. Protection against retaliation for exposure of wrongdoing or reporting of irregularities and misconduct

Following its review of the report of the Office on strengthening the investigative functions in the United Nations (A 58 708), the General Assembly assigned specific responsibility for the investigation of serious misconduct, including sexual exploitation and abuse, to the Office, and requested that I establish an administrative mechanism for the mandatory reporting by programme managers of allegations of misconduct to the Office (resolution 59 287).

Patrols by the military police were insufficient to discourage peacekeepers from engaging in sexual misconduct.

With regard to the conduct and discipline of peacekeepers, the report stressed the importance of the accountability of individuals responsible for acts of gross misconduct and the necessity of the United Nations continuing its zero tolerance policy.

The European Union categorically condemned sexual misconduct and abuse by peacekeepers and was confident that the report which the Special Committee on Peacekeeping Operations had requested would guide the Committee's discussions at the second part of the resumed session.

The Security Council is deeply concerned with the allegations of sexual misconduct by United Nations peacekeeping personnel.

The incentives associated with the winner take all system encourage cheating ranging from questionable practices and ethical lapses to outright misconduct. When the victims themselves or NGOs on their behalf file complaints against police misconduct, public prosecutors as a rule fail to initiate proceedings.
