(d) Grounds of appeal before the United Nations Appeals Tribunal

The courts of justice comprise the Court of Final Appeal, the High Court (which consists of the Court of Appeal and the Court of First Instance), the District Court, the Magistrates' Court, the Lands Tribunal, the Labour Tribunal, the Small Claims Tribunal, the Obscene Articles Tribunal and the Coroner's Court.

His appeal was also rejected. 2.6 In November 1993, a deportation order was issued against him. His appeal was rejected by the Tribunal Administratif de Versailles.

The source alleged further that the right to appeal has also been suppressed by the Military Tribunal.

2.4 On 22 June 1990, the author filed an appeal (recurso de amparo) with the Constitutional Tribunal.

2. Subject to the provisions of article 12, the judgements of the Tribunal shall be final and without appeal.

On 22 August 1995, the authors engaged a second migration agent to appeal to the Refugee Review Tribunal (RRT).

The author then appealed (amparo) to the Constitutional Court (Tribunal Constitucional), which dismissed his appeal on 20 October 2004.

2.2 The author filed an appeal in the Supreme Court (Tribunal Supremo) alleging violations of procedural guarantees and substantive rights.

Furthermore, they were reportedly tried in a closed court room and the right to appeal was suppressed by the Military Tribunal.

The Court also added that an application under article 16 (3) MAL is not an appeal against the decision of the tribunal.

Even where a right of appeal is provided, the confirmation or otherwise of the sentence is not entrusted to a judicial tribunal.

They note that the appeal is to a special, ad hoc appellate tribunal whose members are also appointed by the Head of State.

2.9 President Biya's intention to appeal the judgement, after having ordered the author's rearrest, was frustrated because the law establishing the Military Tribunal did not provide for the possibility of appeal in cases involving high treason.

The author appealed against that order to the Tribunal Administratif de Versailles. The Tribunal rejected his appeal on 26 November 1993 as inadmissible on the grounds of failure to provide a statement of facts and arguments.

In particular, and in contrast to procedures in ordinary criminal courts, there is said to be no right to appeal before a higher tribunal.

SSSC places severe restrictions on the defendant's right to obtain effective legal representation and its verdicts are not subject to appeal before a higher tribunal.

The Commission was informed of the margin appeal that FICSA had launched and of the subsequent decision of the International Labour Organization Administrative Tribunal (ILOAT).

But article 2 (2) of the Protocol also notes, as an allowable exception to further appeal, those cases in which the person concerned was tried in the first instance by the highest tribunal or was convicted following an appeal against acquittal .

Scheduling well in advance and better coordination between the two Tribunals will be required to avoid placing too heavy a burden on the Appeal Chambers of the Tribunal.

He appealed on those grounds against the decision of 27 May 1988 to the Tribunal Superior de Justicia de Cataluña which, on 30 April 1990, dismissed his appeal.

2.3 The author requested a hearing before a tribunal (the Commercial Registration Appeal Tribunal) on the basis of the damages the inspections carried out by the New Home Warranty Program (8 September 1989) and the building inspector of Cobourg (13 September 1989) had caused him.

96. Information consists mainly of public documents issued by the Tribunal or concerning it the Statute, Rules of Procedure and Evidence, the Directive on the Assignment of Defence Counsel, the provisional Rules governing the detention of persons awaiting trial or appeal before the Tribunal, the Code of Ethics for lawyers appearing before the Tribunal, indictments, motions, orders, decisions and so forth.

We appeal to the Tribunal to speed up the process of administering sentences in Rwanda, since the detention facility that meets United Nations standards was completed more than a year ago.

The author did not appeal his sentence, as the decisions of the Tribunal de Honor were not appealable under article 40 (a) of the (old) Spanish Code of Military Procedure (1945).

Concerning the trial of the 19 Ogoni, the Government furthermore stated that their trial had been stalled due to the reconstitution of the Civil Disturbances Tribunal which would now have no military member on it and whose verdict would be subject to appeal to a higher judicial tribunal.

As we welcome this development and commend those who have facilitated such cooperation with the Tribunal, we must continue to appeal for increased support in surrendering to the Tribunal the suspects it seeks. My delegation is under no illusion about the challenges facing the International Criminal Tribunal for Rwanda. The report on agenda item 50 correctly notes that there remain some difficulties requiring solution.

The Court of Appeal dismissed his appeal on 3 October 1988.

Moreover, it transpires from the facts that the Trial Court conviction of the author was reviewed by the Court of Appeal, which is a higher tribunal within the meaning of article 14, paragraph 5.

The Special Rapporteurs welcome the decision of the Government to implement the recommendation of the fact finding mission of the Secretary General to allow for appeal against a decision of the Civil Disturbances Tribunal.

This appeal also mentioned a high official of the Islamic Revolutionary Tribunal who had reportedly denied that this execution had taken place, noting that the Iranian courts had not handed down any such sentence.

Although the establishment of a fourth courtroom and the lifting of the recruitment freeze are likely to improve the functioning of the Tribunal, it remains clear that the expected increase in the caseload during the appeal phase will put additional pressure on the Tribunal and further delay the conclusion of its work.

45. At its third plenary session held at The Hague on 5 July 1996, the Tribunal completed its rules of procedure and evidence and adopted the directive on the assignment of defence counsel and the rules governing the detention of persons awaiting trial or appeal before the Tribunal or detained on its orders.

2.7 On 28 June 1999, the Court of Appeal dismissed the appeal.
