6.3 The author points to a number of circumstances which she claims demonstrate that her son did not benefit from the presumption of innocence.

He claims that this practice is the consequence of the fact that unborn children do not benefit from legal protection and are denied the right to life by the State.

Nevertheless, unresolved and overlapping maritime and territorial claims remain ASEAN s biggest challenge. We believe that maritime cooperation between ASEAN and major powers including China would benefit all countries.

In relation to the claims reviewed in the fifth F4 instalment, the evidence presented to the Panel does not indicate that any profit or other benefit accrued to any of the Claimants in connection with the events or damage in respect of which the claims for compensation have been submitted.

The fourthsecond group of overlapping claims initially consisted of E4 claims related to 39seven category C claims and 24 category C and D claims.

The average number of loss types is 3.14 for the claims in this instalment, compared with 2.01 for all claims in the regular category D claims programme, 1.93 for Jordanian claims and 1.71 for Kuwaiti claims.

Concerning the issue of duplicate claims, the secretariat indicated that it was aware of the risk of duplicate claims from the outset of claims processing and took steps to identify and eliminate such claims during the course of claims processing.

Of these claims, the Panel recommends awards of compensation for two claims, while no awards are recommended for the remaining 16 claims.

The average amount claimed for the claims in this instalment is about USD 2 million, compared to about USD 820,000 for all claims, about USD 934,000 for Jordanian claims and about USD 861,000 for Kuwaiti claims in the regular category D claims programme.

These E4 claims were considered in the second instalment of E4 claims.

The process claims were allowed by the Patent Examiner, while the product claims disallowed.

Of the 24 company claims in this instalment, 19 are stand alone claims four are corporate detainee claims and one is an E2 claim.

The median amount claimed is about USD 470,000 for claims in this instalment, compared with about USD 263,000 for all claims, about USD 335,000 for Jordanian claims and about USD 276,000 for Kuwaiti claims in the regular category D claims programme Approximately 75 per cent of the claims in this instalment contain D8 D9 business losses in relation to unincorporated establishments in Kuwait.

The process of collecting and verifying claims is time consuming, and the net benefit for taxpayers is low. Moreover, the method is vulnerable to illicit practices, such as collecting receipts issued to foreigners and students, who cannot claim their own refunds.

As a result of the computer programme and manual follow up, 37,850 category A claims were identified as confirmed duplicate claims during the course of claims processing.

The E4 claims population consists of claims submitted by Kuwaiti private sector corporations and entities, other than oil sector and environmental claims, eligible to file claims under the Commission's Claim Forms for Corporations and Other Entities ( Form E ).

(v) Provision of secretariat services to the Claims Board and the Advisory Board on Compensation Claims.

The individual category C and D claims in the thirtieth instalment are claims filed through a late claims programme established by the Governing Council for Palestinians who can demonstrate that they did not have a full and effective opportunity to file claims with the Commission during its filing period for individual claims from 1 January 1992 to 1 January 1996 (the regular filing period for individual claims ).

The secretariat has also used these electronic searches for duplicate claims in the Palestinian late claims programme, the Bedouin programme and the category A and C late claims programme.

The fifth F4 instalment includes a number of claims or parts of claims that were deferred from previous F4 instalments or transferred from other claims categories.

As stated above, the eligible category D Palestinian late claims have a higher incidence of loss types and higher amounts claimed than claims in the regular category D claims programme, giving rise to a potential risk of overstatement of the claims.

In addition, the searches identified 287 E4 claims in the remaining E4 instalments as potentially overlapping with 168 claims in category C and 203 claims in category D .

There were only 7,000 widowers receiving survivors' benefit half of them receiving the regular benefit and the other half, the combined benefit.

Similarly, while RRT does not attach weight to minor inconsistencies, it is not required to accept at face value the claims of an applicant although it may give the benefit of the doubt to an applicant who is otherwise credible and plausible.

Details of the claims or parts of claims that were deferred from previous F4 instalments or transferred from other claims categories are discussed in the relevant sections of this report.

Although the category D Panel (the D' Panel ) began its review of claims in 1996, the first five instalments of category D claims did not include any claims for business losses.

As a result, approximately 5,000 duplicate claims were identified and eliminated during the course of claims processing.

At the end of 2002, 166,000 widows received survivors' benefit 95,000 received this benefit alone and another 71,000 were given the combined benefit.

A preliminary examination of these claims revealed that some, but not all, of the Kuwaiti companies in issue had filed claims with the Commission, which were being processed as E4 claims.

The searches identified 104 E4 claims with approved awards of compensation in the first seven instalments as potentially overlapping with 61 claims in category C and 70 claims in category D .

Therefore the Palestinian Panel determined that these two claims were ineligible for inclusion in the Palestinian late claims programme.

Admissibility of claims

(e) Medical claims

Stand alone claims

The Panel reviewed approximately 160 D4 (personal property) claims and 70 D4 (motor vehicles) claims in this instalment.

The Palestinian Panel determined that 17 of the 19 claims were eligible for inclusion in the Palestinian late claims programme.

After these transfers and additions, the claims remaining in the thirtieth instalment therefore relate to 25 claims for the losses of 24 companies and are hereinafter referred to as the claims in this instalment .

Soon after the Panel commenced its review of the eligible category D Palestinian late claims , it became apparent that this claims population exhibits certain features that were not present in the claims in the regular category D claims programme or, if present, were not present to the same degree.

Claims preparation costs A number of category D claimants have made claims for claims preparation costs incurred by them, either in amounts specified on the claim form or in general terms.

The UNCC secretariat commented that it has also assisted the D2 Panel of Commissioners in its review of the category D Palestinian late claims, a claims population with a significant risk of overstated claims.
