During the fourteenth session of Working Group III, an informal drafting group discussed the joint drafting suggestions of Finland, Italy, Japan, the Netherlands, Sweden, and the United States, which were intended to reflect the general consensus in the Working Group (A CN.9 572, para. 89) regarding which types of transactions should fall within the mandatory scope of the draft instrument on the carriage of goods wholly or partly by sea .

Although some aspects of the draft raised concerns, those were issues that could be duly addressed during the drafting of the international legal instrument, for which a working group of the Sixth Committee or an ad hoc committee of the General Assembly should be established.

The derogation scheme suggested could form the basis for further discussion, but that the informal drafting group should be requested to take into account the views outlined in the paragraphs above in its consideration of the necessary conditions required for derogation from the draft instrument.
