On 21 July 2004, the author observed that the State party had not addressed the risk of irreparable harm that he would face upon return to Uganda.

The applicant must then demonstrate that the application concerns a serious issue to be settled by the Court, that he would suffer irreparable harm if no stay were granted, and that the balance of arguments lies in his favour.

On the other hand, in many places such institutions were relentless in their efforts to separate whole generations of indigenous students from their cultural roots and, very often, their families, doing irreparable harm to the survival of indigenous cultures and societies.

Compliance with the provisional measures called for by the Committee in cases it considers reasonable is essential in order to protect the person in question from irreparable harm, which could, moreover, nullify the end result of the proceedings before the Committee.

7.7 The Committee noted that, when it called for interim measures of protection such as those that would prevent the complainant from being deported to Algeria, it did so because it considered that there was a risk of irreparable harm.

The Committee expresses deep concern about information alleging that Suriname is actively disregarding the Committee's recommendations by authorizing additional resource exploitation and associated infrastructure projects that pose substantial threats of irreparable harm to indigenous and tribal peoples, without any formal notification to the affected communities and without seeking their prior agreement or informed consent.

The Chairman also stressed that the Committee had noted with concern the allegation that the Western Shoshone indigenous people were being denied their traditional rights to land and that actions taken by the State party in relation to the status, use and occupation of these lands may cumulatively lead to irreparable harm to this community.

6.1 On 7 and 9 July 2004, the author requested the Committee to seek the State party's assurance that he will not be expelled to Uganda while his communication is under consideration by the Committee, where he would risk suffering irreparable harm, due to his former position as lieutenant during the rule of Idi Amin.

Even more decisively, on 19 December 2001, the Committee had indicated interim measures to stay the complainant's expulsion until it had had an opportunity to examine the merits of the case, the Committee having established, through its Special Rapporteur on interim measures, that in the present case the complainant had established an arguable risk of irreparable harm.

Nonetheless, the Committee is of the view that such a delay of over three years from the dates of the incidents in question would amount to an unreasonably prolonged delay within the meaning of article 4, paragraph 1, of the Optional Protocol, particularly considering that the author has been at risk of irreparable harm and threats to her life during that period.

(b) Ensure that no unaccompanied child, including those from the Democratic People's Republic of Korea, is returned to a country where there are substantial grounds for believing that there is a real risk of irreparable harm to the child, for instance through disproportionate punishment for violating immigration laws, in accordance with the Committee's general comment No. 6 (2005) on unaccompanied minors

(b) Harm means harm caused to persons, property or the environment

Failure to respect that provision, in particular through such irreparable action as deporting an alleged victim, undermined protection of the rights enshrined in the Convention.

In such cases, a remedy which remains pending after the action which interim measures are intended to prevent has taken place is, by definition, pointless because the irreparable harm cannot be averted if the domestic remedy subsequently yields a decision favourable to the complainant there is no longer any effective remedy to exhaust after the action which interim measures were intended to prevent has taken place.

While calculating harm is difficult, there is a growing body of literature demonstrating that cartels cause great harm, especially in developing countries.
