It was stated that it was not possible to understand the rationale for protecting third party holders of non negotiable instruments.

(b) The proceeds take the form of money, negotiable instruments, negotiable documents of title or bank accounts

This implied that that sharing was non negotiable.

In most cases, national legislation establishing requirements to declare the cross border transport of cash was also applicable to negotiable bearer instruments.

In this regard, does Guatemala impose restrictions or controls on the cross border movement of cash, negotiable instruments, precious stones and metals?

It was also stated that in some legal systems reliance was attached to documents other than bills of lading, as well as to documents held by the shipper, and that practice also involved the circulation of non negotiable instruments.

The view was expressed that the proposed draft of article 4 should provide protection only to holders of negotiable documents and to good faith holders of non negotiable documents, in the sense that third party holders of such non negotiable documents are likely to be unaware of the actual nature of the relationship between shipper and carrier, and thus in need of protection.

However, comments had been received from Member States to the effect that the provision was unwarranted because the draft convention did not cover negotiable instruments.

The same report also noted an increase in the number of States requiring declaration of negotiable bearer instruments, from 31 per cent to 45 per cent.

Negotiable documents

It was observed that other matters open for discussion included the time of cessation of the right of control, the formal requirements for giving instructions in the case of non negotiable transport documents and non negotiable electronic transport records, and the obligation of the carrier to follow the instructions of the controlling party, as well as the carrier's liability in this respect.

FATF also suggests that competent authorities be authorized to request and obtain information from the carriers of undisclosed currency or bearer negotiable instruments if they are discovered, and be able to penalize them.

Mr. Boulet (Belgium), endorsing the comment made by the previous speaker, said that draft article 2, paragraph 2, excluded only negotiable instruments and documents of title from the scope of application of the draft convention.

The Americas was the only region where a majority of the States (65 per cent) reported that their national legislation required the declaration of the cross border transport of negotiable bearer instruments exceeding a specified amount.

The law should provide that a security right in a negotiable document and the goods represented thereby is subject to the rights under the law governing negotiable documents of a person to whom the negotiable document has been duly negotiated.

Draft article 1 (p) Negotiable electronic transport record

The international community must work towards universal adherence to disarmament and non proliferation instruments.

The Working Group may wish to consider whether the use of non negotiable transport documents or records for purposes of financing and or e commerce may be enhanced by a requirement that instructions or the replacement of a consignee should be stated on a non negotiable transport record, where one is issued. If so decided, the Working Group may wish to amend article 56(1)(c) as follows

Officials responsible for the operation of the Tribunal's bank accounts or for holding the Tribunal's cash or negotiable instruments are not authorized to exchange one currency for another, except to the extent necessary for the transaction of official business.

This calls upon countries to put measures in place to detect cross border movements of currency and monetary instruments, including a disclosure obligation on travellers backed up by the necessary legal authority for officials at the borders to seize undisclosed currency or bearer negotiable instruments that they suspect to be linked to terrorist financing or other criminality.

Asked whether their national legislation required the declaration of negotiable bearer instruments being transported across borders, 40 per cent of States indicated such a requirement (compared with 45 per cent for the second reporting period and 31 in the first).
