On appeal, the Frankfurt Court of Appeal quashed that decision and referred the matter back to the Frankfurt Regional Court.

On 19 October 1998, the Torun Provincial Court similarly rejected the author's appeal against the decision of the Regional Court.

2.9 On 2 October 2000, the Frankfurt Court of Appeal dismissed the authors' immediate appeal, in the absence of a legal error in the impugned decision of the Frankfurt Regional Court.
