II. HUMAN RIGHTS DIMENSIONS OF THE APRIL 1997 KHARTOUM AGREEMENT

A. Consultations regarding the human rights dimensions of the Agreement

The agreement would be monitored by a human rights verification mission.

The Agreement on the Identity and Rights of the Indigenous Peoples

Among the Agreements, the Mission verifies compliance with the Comprehensive Agreement on Human Rights (hereinafter referred to as the Comprehensive Agreement ), signed on 29 March 1994 (A 48 928 S 1994 448, annex I) and with the human rights aspects of the Agreement on Identity and Rights of Indigenous Peoples (hereinafter referred to as the Agreement on Indigenous Rights ), signed on 31 March 1995 (A 49 882 S 1995 256, annex).

The Agreement establishes a basis for certain rights and freedoms being overseen by a human rights verification mission.

The level of agreement on the Human Rights Council is a disappointment.

Other aspects of the Agreement on Identity and Rights of Indigenous Peoples

Following the signing of the Agreement on Identity and Rights of Indigenous Peoples, MINUGUA was asked to monitor the human rights aspects of the Agreement which were deemed to require immediate implementation.

6. Throughout this period, MINUGUA has continued to verify compliance with the commitments of the Comprehensive Agreement on Human Rights and the human rights aspects of the Agreement on Identity and Rights of Indigenous Peoples, and to report separately on this matter.

Articles 8 (maternity leave) and 11 (rights pertaining to the employment agreement) are replaced.

23. Three national institutions dealing with human rights issues were established by the Dayton Agreement.

That Agreement, known as the Khartoum Agreement, included the issue of human rights and fundamental freedoms. This has been attested to by the Special Rapporteur of the Commission on Human Rights appointed by the General Assembly to study the situation of human rights in the Sudan. Here, I would like to cite some excerpts by way of example. The Agreement stated

In its absence, fears of intervention have prevented agreement on a human rights council and other issues.

' Finally, commentators are also in agreement that non derogable human rights provisions are applicable during armed conflict.

Most of the human rights organizations would like the United Nations to have a robust human rights monitoring role as part of the peace agreement.

37. Section VI of the Comprehensive Agreement on Human Rights, signed on 29 March 1994, which constitutes part of the Agreement on a Firm and Lasting Peace, reads as follows

The agreement includes a human rights clause (art. 2.2), under which returns are to be carried out with full respect for returnees human rights and dignity.

III. Verification of respect for human rights and of compliance with other commitments made in the Comprehensive Agreement

23. The Dayton Agreement created a sophisticated and complex system of human rights protection in Bosnia and Herzegovina.
