Persons with a disability condition before 30 years of age, caused by an illness not related to work, acquire the right to disability insurance on condition that the disability insurance covers at least one third of their working time.

Rights to pension or disability insurance are acquired and exercised under conditions stipulated by law.

Indeed, there is no market for other kinds of recession related insurance provided by the government, such as unemployment insurance, old age insurance, or disability insurance. Instead, the government merely sets an insurance premium and forces everyone to pay it.

The agricultural workers and their families are covered under the Law on pension and disability insurance.

For the exercising of the right related to the pension and disability insurance, as well as determined needs and interests in the area of that insurance, two entity funds for pension and invalid insurance have been established.

Pension disability insurance is among the basic social welfare and basic social security rights, which are acquired based upon work.

Under the State Health Insurance Law, 5754 1994 ( State Health Insurance Law ), every resident is entitled to comprehensive health care services.

They include obligatory pension or disability insurance and voluntary insurance for people in accordance with the laws, rights to old age pensions, disability pension due to reduction or loss of work ability and the death of the insured, and the provision of social security to insured persons and their family members.

Rights to pensions or disability insurance are inseparable personal and material rights they cannot be transferred to other persons or inherited.

The right to pensions and disability insurance is considered one of the basic social rights and social security elements for citizens.

Rights to pension and disability insurance are inalienable personal material rights and they cannot be transferred to or inherited by other persons.

The pension system in Republika Srpska is governed by the Law on Pension and Disability Insurance (Official Gazette of Republika Srpska, 32 00).

Every party that is insured by pension or disability insurance gains the right to disability pension if the disability is caused by an injury outside of work or by disease under the condition that they have fulfilled a pension service that would cover at least one third of their work service.

Operating in the country is a system of insurance that takes two forms State social insurance and voluntary social insurance (article 215 of the Labour Code).

More specifically, 11 programmes of financial support are implemented in the context of the subsidiary and supplementary character of Welfare benefits as opposed to Insurance benefits, depending on the nature and degree of disability, the insurance status etc.

State social insurance funds are spent on benefits (for temporary disability, pregnancy and childbirth, burial, family allowances, etc.), for loss of a breadwinner, for payment of pensions and unemployment benefits, for sanatorium treatment, for recreation for workers and their family members, for food, etc.

The parties that are insured by voluntary insurance based on their agricultural activities gain the right to a disability pension if their disability is caused by a work injury or a profession related illness, regardless of the length of their pension service.

Each person with disability insurance has the right to a pension if the disability was caused by a work related injury or illness, under the condition that he she had pension seniority that covers at least one third of his her working time.

Article 33 Joint stock insurance companies, joint stock insurance holding (group) companies, exclusively foreign funded insurance companies and Sino foreign joint venture insurance companies shall be subject to the present Guidelines, while exclusively state owned insurance companies, branches of foreign insurance companies and insurance assets management companies shall be under the present Guidelines by analogy.

Article 101 With the exception of life insurance business, an insurance company shall reinsure twenty (20) percent of each insurance contract it underwrites in accordance with the relevant State regulations.

Starting from the fact that funds for carrying out the rights to pension and disability insurance are largely provided for from contributions, and that the number of the insured registered for pension and disability insurance disbursements as at 31 December 2001 was 298,497, we arrive at a conclusion that the increase of pensions this year in relation to current number of pensioners will only be symbolic.

The right of every person in Bosnia and Herzegovina to social security and social insurance is provided for through social protection, health care, and pension and disability protection.

Out of a total of 165,481 pensioners to whom pensions are provided in Republika Srpska, as at December 2001, there were 32,510 persons receiving disability pension with an average pension of KM 117.75 (Report on the status of pension and disability insurance and recommendations, April 2002).

The RS Gender centre initiated changes to the RS Law on Employment and Law on Pension Disability Insurance, thus incorporating provisions of the state Gender Equality Law relating to obligation on competent Law implementation authorities to comply with the gender equality and act in a non discriminatory fashion.

Laws on pension and disability insurance clearly define rights that are provided for based upon obligatory and voluntary insurance, according to mutuality and solidarity principles, such as rights of older persons, rights in cases of reduction or loss of the ability to work, and rights in the case of death or injury for provision of insurance to family members.

The Committee requests the State party to include in its next report detailed information on the number of persons who are not eligible for old age or disability pensions under the Serbian Law on Pensions and Disability Insurance and under similar legislation in Montenegro, if any, disaggregated by gender, age and national or ethnic origin, as well as on the type and levels of social assistance received in lieu of such pensions.

Article 149 The State encourages those insurance businesses which facilitate the development of agricultural production.

Under special regulations, children of the insured who became fully and indefinitely disabled for work before they turned 15, i.e. during their period of schooling, have the right to insurance during their disability condition.

The extent of rights depends on the length of pension seniority and salary levels that the insured had during his work period, or the base amounts paid as contributions for pension and disability insurance.

The State applied a voluntary insurance policy to farmers with the premium decided by Provincial People's Committee.
