In the case of State succession, one State may become several or several States may become one.

The author goes on to seek to distinguish the case law relied on by the State party from his case.

The State party has not invoked any such elements in the instant case.

The State party submits that there is no basis to distinguish the present case from the Committee's earlier decision in the Danish case.

In case it is otherwise stipulated by the state, such provisions shall prevail.

We believe that this will be the same case with any sovereign State.

In case it is provisioned otherwise by the state, the related provisions shall apply.

The complainant's case proves it, the State party argues, as his curriculum vitae shows.

The last case also raises issues relating to the jurisdictional immunity of State officials.

The State party requests the Committee to endorse the European Court's case law in this regard.

12.25 The State party acknowledges that no medical certificates have been invoked in the present case.

9.12 The State party argues that the Committee's approach in the present case should be two fold.

4.3 According to the State party, the circumstances of the case were examined fully, thoroughly, and objectively.

In this way, the transmitting State attracts investments from foreign persons who know that, in the general case, the transmitting State will not have the relevant information to exchange with the receiving State.

6.6 In their reply dated 22 August 2004, the petitioners state that the Danish case referred to by the State party is distinguishable from their own case, as the criminal proceedings in that case had been discontinued by the police, without any action being taken by the authors to press civil or criminal proceedings against the alleged perpetrator.

According to the State party, Portuguese law recognizes this form of State liability, but the authors should in this case have instituted proceedings before the ordinary courts.

It may also be concluded that the act of the State can be addressed not only to another State but to other entities, as in the case of Jordan's act and even the declarations of the Swiss Federation subjects of international law, in any case.

The State party's response in this case describes the lengthy review of the author's status by the national authorities.

4.1 On 19 May 2003, the State party submitted its observations on the admissibility and merits of the case.

Our conclusion is supported by the State party's own arguments submitted to the Committee in the earlier Carpo case.

It may be committed by a State agent, in which case it may representrepresents a violation of human rights law. Alternatively, it may be committed by a non State agent, in which case there will be no violation of human rights law unless the State, in the circumstances, was required to protect the victim from the act or omission.

In the case of the author, the State party maintains that while the case was being investigated (3 years and 11 days), the author did not make any request for specific relief.

4.24 Applying this test, the State party argues that the current case is more in line with Aylor Davis.

However, exceptions could be made (except in the case of China) in case of invasion or any other attack against the nuclear Powers, their territory, their armed forces or their allies, or any State with which they have a security commitment, by a non nuclear weapon State in association or alliance with a nuclear weapon State .

The State party concludes that there has been no violation of article 26 of the Covenant in the present case.

In that case, the State had, until 1998, granted additional paid leave for radiation related work in the health sector.

In the case of a violation, the treaty body requests the State party to take appropriate steps to remedy the violation.

For the purposes of international responsibility, there would be no reason for distinguishing the case of an international organization aiding or assisting a State or another international organization from that of a State aiding or assisting another State.

The State party also points out that the case has been widely reported in national media and has received international attention.

And article 27 provides that the receiving State shall, even in case of armed conflict , respect and protect the consular premises.

9.5 The State party considers the rights of parents under article 18, paragraph 4, to be the core issue of the case.

In the case of passage through the territorial airspace of another State, international air law should be applied to the aerospace object.
