Federal Code of Criminal Procedure

It underlines that under section 250j, paragraph 3, of the Czech Code of Civil Procedure, an administrative authority is bound by the legal opinion of the court.

According to the Civil Code and the Code on Administrative Offences, legal entities might be subject to property and administrative liability.

Those provisions have been incorporated into the Code of Criminal Procedure.

The Code of Criminal Procedure provides for special regulation for collecting evidence.

The new code also introduces the concept of administrative receivership, whereby lawyers, certified accountants, and other intermediaries act as managers of enterprises undergoing bankruptcy. The procedure abolishes the Liquidation Team, a long standing regime that many alleged was unjust, aggressive in administrative intervention, unprofessional, and unaccountable.

The penal code and the code of criminal procedure include provisions specifically for the administration of justice with respect to minors.

The application of the 2004 interim criminal procedure code has been particularly problematic.

On 1 July 2004, the new Code of Criminal Procedure entered into effect.

In accordance with the legislative programme of the government, the draft Code of Administrative Procedure was approved by the Council of Ministers on 20 January 2005 and was introduced in the Bulgarian Parliament for debate and adoption.

The package includes a transitional criminal code, a transitional code of criminal procedure, a transitional detention act and a model transitional police directive.

Concerning the Code of Criminal Procedure, bank secrecy may not be invoked before a court.

The Judiciary Act and the Code of Civil Procedure was amended on 1 January 2002.

The conditions and procedure for granting mutual legal assistance are specified in articles 5 to 10 of the Code of Criminal Procedure and article 12 of the Criminal Code, and are regulated by the bilateral and multilateral agreements on this subject.

Positive aspects The Committee notes with satisfaction the enactment of new legislation containing anti discrimination provisions, including the Criminal Code and the Code of Criminal Procedure.

People are still being detained beyond the time limits established under the Code of Criminal Procedure.

The actions of the Chinese judicial authorities in the present case have been strictly guided by the Chinese Penal Code, Code of Criminal Procedure and so forth.

(b) The amendments to the Family Act, the Criminal Code and the Criminal Procedure Act in 2003

(c) The new draft federal code of criminal procedure on the rights of persons detained in police custody that prohibits incommunicado detention (mise au secret)

According to the Code of Criminal Procedure, an investigative body or a Prosecutor's Office commences criminal proceedings if there is reason and grounds for it.

A new section, 174 A, was added to the Code of Criminal Procedure, 1898, in 2001 which is specifically directed at curbing dowry related violence.

On 29 July, the Parliament gave its authorization for the adoption of the penal code and of the penal and civil procedure codes by government decree.

The Committee welcomes the Magistrates Code of Procedure (Amendment) Act of 1993 which revised the laws to ensure better provision of child maintenance by absent fathers.
