Admittedly, however, a protocol would need to be developed to broaden its scope of application to all United Nations operations and eliminate the requirement of the declaration of exceptional risk.

This aspect of the author's communication falls outside the scope of application of article 14, paragraph 1, and is, therefore, inadmissible ratione materiae under article 3 of the Optional Protocol.

4.3 The State party argues that the communication is also inadmissible under article 5, paragraph 2 (a), of the Optional Protocol, because the author had already filed an application with the European Court.
