The PTA facilitates arbitrary arrest, lengthy detention of suspects without trial and attendant abuses.

This conundrum is symbolized by the debate over detaining terrorism suspects without charge or trial. Initially, Blair attempted to force through detention without charge for up to 90 days.

3.3 The author argues that his imprisonment without a fair trial amounts to arbitrary detention, in violation of article 9 of the Covenant.

The prolonged pre trial detention of Yvon Neptune and Jocelerme Privert is an emblematic example.

On 5 September 2001, the District Court of Riga maintained the detention order up to trial.

Two Trial Chambers were running three trials full time, nine indictees were in detention and the Court's work should be completed by early 2007.

3.2 The author contends that his detention and trial were politically motivated, in contravention of his rights under article 19, paragraphs 1 and 2.

Particularly problematic developments since 11 September 2001 have included the indefinite, prolonged or incommunicado detention of terrorist suspects without access to courts, the unacknowledged or secret detention of suspected terrorists, and the detention of children in connection with anti terrorism measures.
