In 75 per cent of the D1 (departure) claims and 35 per cent of the D1 (MPA) claims, claimants failed to prove the essential legal requirements of ownership, loss or causation.

When a legal person, such as a corporation, requested diplomatic protection, claims for compensation were usually brought by the State of nationality on behalf of the legal person.

These reports covered, inter alia, the claims in this instalment and presented the significant legal and factual issues identified therein.

Accounts receivable reported in statement III do not include claims against Governments for, inter alia, damages to Agency property amounting to 12,506,852. They are in the nature of memorandum accounts. As the collection of these claims is considered doubtful, a provision of 100 per cent has been set up against these claims.

The Committee notes that in some instances the amounts of the claims made against the United Nations have been scaled down, and settlements are lower than the original claims.
