The Procurement Services should investigate ways in which the procurement plan can be enhanced as a tool in the management of the entire procurement process.

It would seem that IAPSO is at present the only organization in the procurement system to have successfully automated its entire procurement process.

Upon promulgation, the Chief Procurement Officers will be instructed to distribute the guidelines to all staff members who are associated with the procurement process.

(d) Take steps to ensure that all staff members involved in the procurement process are fully conversant with the application of the proposed procurement system.

Client satisfaction surveys should thus be part of the process of measuring procurement performance.

It was not exactly clear which requisition for purchase date begins the actual procurement process.

In paragraph 39, the Board recommended that UNRWA promote the internalization and awareness of its procurement standards of conduct among all staff associated with the procurement process.

For staff members involved in the procurement process, the Secretariat has developed ethical guidelines in simple language and with practical examples to help them interpret how they should conduct themselves when confronted by an ethical issue associated with the procurement process.

The Procurement Service is also in the process of promulgating a United Nations vendor code of conduct.

It was observed that the consequences of not doing so would be extremely disruptive for procurement process.

The Working Group noted the advantages of publishing information on forthcoming procurement opportunities, such as transparency in the procurement process through reducing cases of ad hoc and emergency procurements, and, consequently, less frequent recourse to less competitive methods of procurement.

While the application of ICT systems to the procurement process should certainly bring multiple benefits as summarized above, the organizations also have a mandate to strengthen public procurement capacities in the recipient countries so as to enable them to perform direct procurement operations.

It focuses on strategic issues most likely to contribute to enhancing the cost effectiveness of the procurement process within and among the organizations, namely cooperation and coordination, electronic procurement and capacity building.

(6) Procurement regulations may establish procedures for maintaining and accessing the record of the procurement proceedings, including measures to ensure the integrity, authenticity, accessibility and, where appropriate, confidentiality of information, the traceability of steps in the procurement process, and the interoperability of record retention systems.

A number of high level recommendations have been made, which if properly implemented, could further strengthen the procurement process.

The Procurement Services has identified a number of key aspects that will assist in further strengthening the process, notably

The Inspector was informed that e procurement systems could compress process time cycles from four weeks to four days.

In paragraph 362 of the report, UNDP agreed with the Board's recommendation that it implement procedures to review environmental concerns during the procurement process, using the guidance provided in the UNDP Procurement Manual.

4. Recognizes that procurement reform is an ongoing process and should focus, inter alia, on ensuring the efficiency, transparency and cost effectiveness of United Nations procurement as well as strengthened internal controls, greater accountability to Member States and full implementation of General Assembly resolutions on procurement reform

While most of the procurement staff are familiar with the standards of conduct, updated by inter office memorandum dated 21 November 2004, the Procurement and Logistics Division agrees that familiarity with those standards needs to be documented and extended to all staff associated with the procurement process.

It was observed that the UNCITRAL Model Law on Procurement of Goods, Construction and Services (the Model Law ) contained procedures aimed at achieving competition, transparency, fairness, economy and efficiency in the procurement process and that it had become an important international benchmark in procurement law reform.

The Inspector however understands that substantive legal aspects of procurement are best handled by the legal counsel of the organization concerned, which would therefore call for improved coordination between the office of legal counsel and procurement units earlier in the procurement process, before contracts are concluded.

Further requests the Secretary General to issue ethical guidelines without delay for those involved in the procurement process, requests that those guidelines be shared with Member States through the procurement web site, and reiterates its request to the Secretary General for the early adoption of a code of conduct for vendors and a declaration of ethical responsibilities for all staff involved in the procurement process

Under those rules, substantial discretion as regards the conduct of procurement process is often given to the heads of procuring entities.

Since the guidelines were apparently intended for suppliers rather than for procurement staff, they do not stipulate the ideal or generic qualifications required of procurement officials, desirable quality standards of the procurement process, or the responsibilities and modus operandi of contract review bodies, both at Headquarters and field duty stations.

In addition, the Board of Auditors and the Office of Internal Oversight Services (OIOS), which identified the procurement function as a high risk area, periodically review the reform process and audit procurement practices of the funds and programmes.

According to UNPD, some functions pertaining to procurement, such as preparation of specifications, contract management, accounts payable, follow up on claims and litigation are performed outside the procurement units a fact to be considered in the benchmarking process.

In December 2002, the General Legal Division proposed to the Procurement Service that a team composed of the requisitioner, the Procurement Service and the Office of Legal Affairs should be convened at an early stage in the procurement process so that major legal issues that were likely to arise could be addressed.

Also relevant is the number of transactions or tasks required to complete the procurement process from authorization to payment and closure of accounts.

10. Stresses the importance of developing and implementing an ethics and integrity programme for the procurement staff, and requests the Secretary General to complete and issue ethics guidelines no later than June 2007 for all staff involved in the procurement process

When the Model Law was prepared in the 1990s, the then Working Group worked on the basis that clear and readily accessible laws and regulations relating to procurement would promote transparency and create predictability and confidence in the procurement process.

A consensus appears to be emerging at the international level that, if properly used, ERAs generate substantial savings for governments without undermining, but rather enforcing, such procurement objectives as economy and efficiency in procurement, transparency, fair and equitable treatment of all suppliers, and the integrity and fairness and public confidence in the procurement process.

(b) Review existing policies, procedures and guidelines to determine whether they are sufficiently flexible to cater for the requirements of a computerised procurement process.

Although procurement training needs were identified and communicated to HRM, it appears as if this identification process was not done in a structured manner.

12. Requests the Secretary General to further enhance transparency in the procurement decision making process through, inter alia, the establishment of an independent bid protest system outside of the reporting hierarchy of the Procurement Division of the Department of Management of the Secretariat in order to furnish vendors participating in tenders with a means of disputing procurement related decisions

UNDP welcomes the comprehensive scope of the report and in particular, agrees with those strategic issues that can contribute to enhancing the cost effectiveness of the procurement process within and among the organizations namely, cooperation and coordination, electronic procurement and capacity building.

To that end, the Chief of the Procurement and Logistics Division reminded all section heads and field procurement and logistics officers at a recent meeting held in Amman from 2 to 4 May that they must ensure that all staff involved in the procurement process reread the standards of conduct and sign an acknowledgement form stating that they have done so.

While not questioning the potential benefits of, and opportunities presented by e procurement noted above, FAO points out that it is seeking to utilize the procurement modules of its broader Oracle Financials applications to automate the process and is investigating the possibility of utilizing Oracle i procurement for frequently purchased items in response to possible increases in local purchase limits.
