103. Work training contract

(a) The On the Job Training Contract (CEF).

Under this type of contract, the contracting firm agrees to give the young person general technical training during the first phase of his contract and to submit an individualized training plan to the Ministry of Labour and Social Security if the contract runs to more than one year.

The basic training will be complemented with advanced training courses in such areas as legal issues, outsourcing, contract management, e procurement, and ethics.

Female trainees, who are pregnant when carrying out the vocational training contract and certified by a medical center at district level or higher that the training would negatively affect the fetus, have the right to terminate the contract without paying compensation.

The decision is aimed at setting standards for the monitoring and control of apprenticeship contracts, defined as a form of contract distinct from a contract of employment, having training as its objective.

Firms undertake to conclude a contract to satisfy the training objectives of the apprenticeship and to provide proper health coverage.

Government Decree 02 2001 ND CP on January 9, 2001 on Vocational Training stipulating that female trainees do not have to compensate for vocational training fee when terminating the training contract if they have documents issued by health authorities at district level or higher certifying that prolonging such a contract would have bad effect on the fetus after maternity leave, if she wishes and is eligible, she can continue the training.

It is necessary to ensure training for new recruits irrespective of the type of contract and level of the staff involved.

43. Ministry of Labour and Social Security decision No. 1155 introduced a form of labour contract involving on the job training for young people.
