(d) The attempt to commit an offence described in subparagraph (a)

It is also an offence under the ATCSA for anyone to aid, abet, procure, counsel or incite a non UK national to commit an offence under section 1, BWA outside the UK.

It is also an offence under the ATCSA for anyone to aid, abet, procure, counsel or incite a non UK national to commit an offence under section 2, CWA outside the UK.

In addition, an attempt to commit and participating as an accomplice in an offence as set forth in Section 153 a are also criminalized.

(c) Organizing or directing other persons to commit an offence established in accordance with paragraph 1 of this article.

(ii) To commit an offence as described in subparagraph (a) or (b) in order to compel a natural or legal person, an international organization or a State to commit or to refrain from committing an act.

(a) If the defendant is preparing to commit, is in the process of committing or has just committed an offence

Any person who attempts, or who commits an act constituting participation as an accomplice in, any such smuggling, in an attempt to commit such smuggling, or organizing or ordering others to commit such smuggling likewise commits the offence.

Children under the age of 15 who commit an offence cannot be made subject to punishment according to the Criminal Act.

(b) Organizes or directs others to commit an offence as set forth in paragraph 1, 2 or 3 of the present article or

Any person who attempts to commit or who commits an act constituting participation as an accomplice in any such trafficking and transport, in an attempt to commit such trafficking and transport or in organizing or ordering others to commit such trafficking and transport likewise commits an offence within the meaning of this Protocol.

It is also an offence under the ATCSA for anyone to aid, abet, procure, counsel or incite a non UK national to commit an offence under section 47, ATCSA outside the UK. Financial assistance is included in both definitions.

(a) Subject to the basic concepts of its legal system, attempting to commit an offence established in accordance with paragraph 1 of this article

(ii) Be made in the knowledge of the intention of the group to commit an offence as set forth in paragraph 1 of the present article.

The second, alternative component of identity theft involves the actual use of the personal information to attempt to commit, or actually to commit, a criminal offence.

2. Each State Party may adopt such legislative and other measures as may be necessary to establish as a criminal offence, in accordance with its domestic law, any attempt to commit an offence established in accordance with this Convention.

In most States, if the perpetrator does not commit a criminal offence in order to obtain the personal information, as for example by committing theft, the acquisition and possession of the personal information itself do not constitute an offence.

Accordingly, a request for extradition or for mutual legal assistance based on such an offence may not be refused on the sole ground that it concerns a political offence or an offence connected with a political offence or an offence inspired by political motives.

For the purposes of extradition between States Parties, the offence of enforced disappearance shall not be regarded as a political offence or as an offence connected with a political offence or as an offence inspired by political motives.

Accordingly, article 2, paragraph 3, stipulates that the funds need not actually be used to commit the intended offence.

Any serious criminal offence of mercenary activity required a specific intention to commit or knowledge of the criminal activity.

At this stage, there has been no actual use of the information to try to commit, or actually to commit, a criminal offence, such as fraud, theft or impersonating another individual.

For the purposes of extradition between States Parties, the offence of enforced disappearance shall not be regarded as a political offence or as an offence connected with a political offence or as an offence inspired by political motives. Accordingly, a request for extradition based on such an offence may not be refused on these grounds alone.

However, as provided in Chapter 34 a, section 5(4) of the Penal Code, the penal provisions on the financing of terrorism do not apply if an act is punishable as an offence referred to in paragraph 1, subparagraphs 1 to 5 or as an offence provided for in section 1 or 2 of Chapter 34 a, or as an attempt to commit any of such offences, or if it is punishable as complicity in such an offence.

Such an offence was usually an economically motivated crime.

Each party shall adopt such measures as may be necessary to establish as a criminal offence under its domestic law, when committed intentionally, the participation as an accomplice in or the organization or direction of others to commit an offence in the field of drug trafficking or other forms of organized crime.

Where an offence is ongoing, the Act deems each day to constitute a separate offence.

Money laundering treated as an extraditable offence

Each State Party shall, as necessary, establish in its domestic legislation the possibility that legal persons may be held liable if they knowingly commit or otherwise participate in , or derive profits from , an offence established in article(s) ___ alternatively an offence covered by this Convention .The scope of this Convention is still subject to deliberation.

(ii) To commit an offence described in subparagraph (a) or (b) in order to compel a natural or legal person, international organization or State to do or to refrain from doing any act

is guilty of an offence against this section

5. For purposes of extradition between the States Parties, none of the offences set forth in article 1 shall be regarded as a political offence or as an offence connected with a political offence or as an offence inspired by political motives.
