The legal instruments for cultural diversity have just been enriched today by UNESCO's adoption, by an overwhelming majority, of the Convention on Cultural Diversity, which removes culture from the rules of international trade.

Moreover, the European Commission was duty bound to maintain the European Community's powers to adjust its rules to developments in areas covered by the draft convention.

With a view to addressing peacetime trafficking in cultural property, the Convention on the Means of Prohibiting and Preventing the Illicit Import, Export and Transfer of Ownership of Cultural Property was adopted by the United Nations Educational, Scientific and Cultural Organization (UNESCO) in 1970.

The Committee welcomes the State party's ratification of the Framework Convention for the Protection of National Minorities in 2000, the European Convention for the Protection of Human Rights and Fundamental Freedoms in 2002 and the European Social Charter in 2004.

The European Union believes that the provisions of the Chemical Weapons Convention must be strictly applied.

This law is harmonized with the International Convention on the Elimination of all Kinds of Racial Discrimination and European Framework Convention for the Protection of National Minorities.

Otherwise, if the European Union passed a law that was not in compliance with the convention, its member States might be compelled to denounce the convention themselves.

Mr. Meyer Bisch pointed out that the recent adoption of the UNESCO Convention was proof that protection of cultural diversity and individual cultural rights were not putting at risk the universality and indivisibility of human rights.

The 1954 Convention for the Protection of Cultural Property in the Event of Armed Conflict first introduced the definition of cultural property and provides safeguard measures in wartime that have been strengthened by its two protocols.

The Convention sought to reaffirm the link between culture, development and dialogue and to create an innovative platform for international cultural cooperation.
