12.21 Before the European Court, the applicants claimed that Turkey had violated, inter alia, article 3 of the European Convention.

A similar possibility exists in relation to the European Convention on Human Rights.

However, at the same time it declared that it would apply the Convention in relations with the States parties to the European Convention on Extradition, opened for signature at Paris on 13 December 1957, provided that the Organized Crime Convention supplemented and facilitated the application of the provisions of the European Convention.

American Convention, arts. 8, 9 European Convention, arts. 6, 7 article 40 of the Convention on the Rights of the Child prescribes similar protections relating specifically to proceedings involving children.

The European Union reaffirms its commitment to developing measures to verify compliance with the Convention.

For example article 27 (1) of the European Convention on Transfrontier Television, Strasbourg, 1989, provides

Moreover, the European Commission was duty bound to maintain the European Community's powers to adjust its rules to developments in areas covered by the draft convention.

The Committee welcomes the State party's ratification of the Framework Convention for the Protection of National Minorities in 2000, the European Convention for the Protection of Human Rights and Fundamental Freedoms in 2002 and the European Social Charter in 2004.

The European Union believes that the provisions of the Chemical Weapons Convention must be strictly applied.

2.8 On 22 October 1996, the author applied to the European Commission of Human Rights, alleging, inter alia, a violation of article 6 of the European Convention.

Of course, the European Convention does not govern the jurisprudence of the United Nations Human Rights Committee.

This law is harmonized with the International Convention on the Elimination of all Kinds of Racial Discrimination and European Framework Convention for the Protection of National Minorities.

Otherwise, if the European Union passed a law that was not in compliance with the convention, its member States might be compelled to denounce the convention themselves.

Another recent instrument in the same direction is the European Framework Convention for the Protection of National Minorities.

The European Commission, acting on a mandate from the European Council of Ministers, supported the inclusion of article 16 bis on regional economic integration organizations (REIOs) in the draft convention.

The European Commission hoped that the Commission would accept the proposed disconnection clause, since it would otherwise be unable to commit the European Community to ratification of the draft convention.

However, neither the European Convention nor its Protocols contain provisions equivalent to articles 10 and 26 of the Covenant.

The European Court examined the matter, when declaring the application inadmissible under article 35, paragraph 4, of the European Convention, on the ground that the author's complaints do not disclose any appearance of a violation of the rights and freedoms set out in the Convention or its Protocols .

The Committee notes with satisfaction the signing of Protocol No. 12 on non discrimination to the European Convention on Human Rights.

The Erdoğan government adopted legislation that lent credence to its false narrative. The European Commission looked with approval on a succession of initiatives a new penal code adopting modern European standards, training programs on the European Convention of Human Rights, expert missions from the European Union, and constitutional amendments seemingly guaranteeing much greater judicial independence.

Ms. Struncova (Observer for the European Commission) said that, although the European Commission was responsible for making declarations under the draft convention regarding matters in respect of which it had competence, responsibility for deciding in which areas the European Commission shared competence with member States or had exclusive competence lay with the European Council.

In 2001, the European Court of Human Rights had found Turkey responsible for numerous violations of the European Convention on Human Rights with respect to the enclaved Greek Cypriots in the northern part of Cyprus.

In relation to the largely congruent provision of article 6, paragraph 1, of the European Convention, the European Commission has decided that disputes concerning the judiciary, despite their independence from the executive branch, fall outside the scope of article 6. Regarding compensation of victims, Lithuania signed the 1983 European Convention on the Compensation of Victims of Violent Crimes on 14 January 2004.

The latter reflects Denmark's obligations under article 3 of the European Convention on Human Rights and hence article 7 of the Covenant.

The Committee observes that articles 8 and 17 of the Covenant largely converge with articles 4 and 8 of the European Convention.

6.2 The State party recalls that Protocol No. 12 to the European Convention on Human Rights has not yet entered into force.

The author cites the European Code of Social Security of 1964, the European Convention on the Legal Status of Migrant Workers of 1977, and International Labour Organization Conventions Nos. 97 and 157, all ratified by Spain.

2.12 On 1 February 1999, the authors submitted an application to the European Court of Human Rights, alleging that the length of compensation proceedings in relation to the Dresdner Bank, Daimler Benz and IG Farben shares violated article 6 of the European Convention, whereas the denial of any compensation for these shares breached their right to property (as enshrined in article 1 of Protocol No. 1 to the European Convention).

The question as to whether the European Union would ratify the convention would be decided according to the Union's normal decision making procedure.

As at 30 June 2005, 147 States and the European Community were parties to the Convention and therefore members of the Authority.1

The State party recalls the Committee's decision on the complaint presented by the complainant's wife where the same guarantees were considered effective, and refers to relevant decisions of the European organs under the European Convention on Human Rights.
