These are, primarily, the Human Rights Chamber and the Bosnia and Herzegovina Ombudsman and Entity offices of the Ombudsman for Human Rights.

Using the materials developed for the Office of the Human Rights Ombudsman, MINUGUA provided human rights verification training for dozens of local organizations.

The Government of Ramiro de León Carpio, a former human rights ombudsman, signed the Comprehensive Human Rights Agreement and welcomed MINUGUA into the country.

A major emphasis was on strengthening the Office of the Human Rights Ombudsman, especially its field offices.

(b) To implement the decisions of the Commission on Human Rights on Bosnia and Herzegovina, the Office of the Human Rights Ombudsman and the Human Rights Chamber, and the decisions of the Commission for Real Property Claims of Displaced Persons and Refugees

The Provedor for Human Rights and Justice the Ombudsman has been sworn in and has launched his initiatives for the current year.

The Commission also notes the work of the Office of the Ombudsman and other State institutions in the defence of human rights.

MINUGUA worked with the Office of the Human Rights Ombudsman in many ways, sharing databases and methodologies, discussing cases and conducting joint verifications.

The two principal themes discussed related to transparency and democracy, and the role of the ombudsman in strengthening the international human rights system.

Ombudsman institutions in both Entities are formed based on the Law on the Ombudsman of Republika Srpska and the Federation of Bosnia and Herzegovina, respectively, which act as domestic institutions, but still lack a substantive influence in the area of human rights protection.

In addition, the Mission's field offices facilitated an increased role of the Office of the Human Rights Ombudsman in round tables and other participatory forums that MINUGUA fostered over the years to address human rights, justice and other peacebuilding problems at the local level.

The Committee welcomes the establishment of the Office of the Human Rights Commissioner of the Republic of Azerbaijan, pursuant to the Constitutional Act on the Ombudsman, adopted in December 2001.

The Committee notes with appreciation the adoption of the Law on the People's Rights Defenders (Ombudsmen), the election of the first Ombudsman in November 2002 and the establishment of a section for children's rights issues within the Office of the Ombudsman.

Based upon the above, a conclusion can be made that the institution of Ombudsman in Bosnia and Herzegovina, in accordance with its responsibilities and mandate set forth by the Law on the Ombudsman for Human Rights, takes measures, implements activities and gives recommendations in order to achieve at the complete realization of the rights recognized by the International Covenant on Economic, Social and Cultural Rights in Bosnia and Herzegovina.

Following the ratification of the U.N. Convention on the Rights of the Child by Law 2101 99, Greece established the operation of the Children's Ombudsman, in the context of the Citizen's Ombudsman.

Those funds were directed mostly towards strengthening major State institutions, such as the Public Ministry, the Public Defenders Office, the Judiciary School, the Office of the Human Rights Ombudsman and the penitentiary system.

While taking note of the establishment of the office of Ombudsman, the Committee regrets the absence of a national human rights institution set up in accordance with the Principles relating to the status of national institutions for the promotion and protection of human rights (the Paris Principles, General Assembly resolution 48 134, annex).

The National Parliament's endorsement on 29 March of Sebastiao Dias Ximenes as the first Provedor (Ombudsman) for Human Rights and Justice of Timor Leste should pave the way for this important Office to begin its work.

The General Accounting Office of the Republic, the Office of the Attorney General, the Office of the Human Rights Ombudsman, the Superintendency of Banks and the Superintendency of Pensions are oversight bodies vested with constitutional authority.

The Committee commends the establishment of an Advisory Commission on Human Rights, a Complaints Office within the Permanent Special Commission against Racial Discrimination, advisory commissions for foreigners in the communes, and the appointment of an ombudsman.

The NI Unit provided support to the third Regional Conference of the Caribbean Ombudsman Association, held in Jamaica from 10 to 14 May 2004, through the participation of the former Secretary General of Canada's Human Rights Commission, who spoke on the Paris Principles and the importance of Ombudsman's offices having a human rights mandate.

While welcoming the adoption of the Law on the People's Rights Defenders and the fact that the Office of the Ombudsman has established a specific department dealing with children's rights, the Committee is concerned that the Law does not specifically empower the Ombudsman to receive and address individual complaints from children.

During 2004, while generally scaling back its good offices efforts, MINUGUA worked with others to secure the release of journalists held by former civil patrollers and staff of the Office of the Human Rights Ombudsman in separate incidents.

4.4 Thirdly, the State party holds that the communication is inadmissible as the matter was submitted to the Human Rights Committee on 16 April 1998, five years after the Ombudsman handed down his decision on 5 July 1993.

In addition to the above mentioned activities, the CBSS has monitored the situation in member states with regard to the protection of human and civil rights and has focused on supporting the building and strengthening of democratic institutions, such as the Ombudsman, to ensure inter alia that there is a balance between counter terrorism measures and the protection of human rights.

The Ministry of Justice and its human rights division had established commissions in 1997 and again in 2004 to draft an Ombudsman Act, which had now been completed in the form of a bill, providing for 1 ombudsman and 5 to 10 assistant ombudsmen, whose division of work, including the area of gender equality, would be regulated subsequently by by laws rather than in the legislation itself.
