Labour shall be regulated on the basis of an employment agreement (contract) in accordance with labour legislation.

The minimum wage covers all workers and employees under labour contract.

43. Ministry of Labour and Social Security decision No. 1155 introduced a form of labour contract involving on the job training for young people.

The Labour Code also regulates the employment of domestic workers, establishing their working hours and contract conditions and how compensation is to be calculated if their contract is terminated without cause.

As used in the social insurance legislation, the term workers means individuals employed, in accordance with the provisions of the Labour Code, on the basis of a contract of employment, appointment, election or nomination or a cooperative contract of employment (art. 2 of the Labour Code).

A collective labour contract shall not contain clauses which are less favourable for workers and employees than those established by the law (art. 50, para. 2, of the Labour Code).

303. Work protection in connection with maternity is provided for in the Labour Code and concerns women workers employed on the basis of an employment contract, appointment, election, nomination or cooperative work contract.

Under this type of contract, workers may not be hired to replace workers who have stopped working because of labour union activities.

Under this type of contract, the contracting firm agrees to give the young person general technical training during the first phase of his contract and to submit an individualized training plan to the Ministry of Labour and Social Security if the contract runs to more than one year.

According to the Labour Law, article 68, salaries of employees are defined by collective contract, labour regulations and work contracts as such, each salary is unique for a position, held by either men or women.

A labour contract cannot be cancelled by an employer while a worker is on leave, except when the business is being liquidated or the businessman is terminating his activities (article 46 of the Labour Code).

If an employer is not able to secure reassignment, women have the right to a leave with compensation, pursuant to their collective contract and labour rules.

The two largest organizations are Silinermik Inuutissarsiuteqartut Kattuffiat (SIK The Greenland Labour Organization) and the Central Organization of Public Servants and Contract Employees in Greenland (NAK).

As the apprenticeship contract does not give rise to a labour relationship between the parties, basic health and insurance coverage for the apprentice must be specified.

(c) To persons who have lost their jobs because of labour contract termination, who have been engaged for half time jobs with wages below the minimum wage.

119. The Ordinance defines the term workmen in wide terms as any person who has entered into or works under a contract with an employer in any capacity, whether the contract is expressed or implied, oral or in writing and whether it is a contract of service or apprenticeship or a contract personally to execute any work or labour, and includes any person ordinarily employed under such contract, whether such person is or is not in employment at any particular time .

Act No. 24.465 provides for a type of contract (different from a contract of employment) which is designed to establish links between firms and unemployed young people to give them work experience and training and is monitored by the Ministry of Labour and Social Security.

During the job placement period, those women continue to receive their wages, but for no more than three months after the expiration date of the labour agreement (contract).

An employer cannot refuse to employ a pregnant woman, cancel her labour contract or, except in cases when it is in the interest of her health, reassign her to other positions.

More favourable conditions than those established in the legislation can be agreed upon by means of the collective labour contract and also by individual agreements between the parties in employment relations.

Further, with regard to contractual obligations, the OIOS review disclosed that the contractor had failed to furnish bonds to the United Nations for performance, labour or materials, as required by the contract.
