Extradition is governed by the Act of 10 March 1927.

The Enabling Act for the SAARC Regional Convention on Suppression of Terrorism 1991 The Extradition Act 1991.

It declared that it would render cooperation on extradition on the legal basis provided under the Extradition Act of 1992 of Malaysia.

When the Supreme People's Court receives an extradition request, it designates a high people's court to determine whether the request complies with the Extradition Act and the pertinent extradition treaties.

Under article 8, paragraph 1, of the Act, when the object of an extradition request is a Chinese national, China will refuse extradition.

According to article 7 of the Extradition Act and to bilateral extradition treaties China has signed, extraditable offences must conform to the following criteria.

The Extradition Act of the People's Republic of China, which took effect on 28 December 2000, sets out in detail the terms under which China may enter into cooperative extradition agreements with other States.

1.8 In regard to the modalities concerning mutual assistance in criminal matters, particularly the extradition of criminals, the Extradition of Fugitive Criminals Act of 1927, subsequently amended pursuant to Act No. 33 of 1972, was made law and published in the Official Gazette No. 160 of 1 July 1927.

Upon reception of a request from a foreign State, it determines whether the request and its annexes are complete and in compliance with the formal terms of the pertinent extradition treaty and the Extradition Act.

According to article 3, paragraph 1, of the Act, China enters into extradition agreements with foreign States on a basis of equality and reciprocity. Article 6, paragraph 3, stipulates that the term extradition treaty refers to any extradition treaty between the People's Republic of China and another State or to which both States are party, and to any other treaty that contains provisions governing extradition.

For States not bound to Burkina Faso by an agreement or convention on judicial cooperation, the text that applied in the case of a request for extradition was the legislative act of 10 March 1927 on the extradition of foreigners.

Ukraine noted that article 29 of the Anti Terrorism Act provides legislative support for the extradition of persons who have participated in terrorist activities.

Extradition shall be subject to the conditions provided for by the domestic law of the requested State Party or by applicable extradition treaties, including, inter alia, conditions in relation to the minimum penalty requirement for extradition and the grounds upon which the requested State Party may refuse extradition.
