When the Supreme People's Court receives an extradition request, it designates a high people's court to determine whether the request complies with the Extradition Act and the pertinent extradition treaties.

An extradition request should not display any features defined under article 8 of the Extradition Act as reasons for which an extradition request should, or under article 9 as reasons for which it may, be rejected.

In such a situation, China may thus reject the extradition request.

Under article 8, paragraph 1, of the Act, when the object of an extradition request is a Chinese national, China will refuse extradition.

The CTC wishes therefore to learn what provisions will govern an extradition request submitted by a non Commonwealth country that does not have an extradition treaty with Seychelles.

One State reported that a request for extradition that was being processed was discontinued because the person whose extradition was requested was subsequently naturalized in the requested State.

If a State Party which makes extradition conditional on the existence of a treaty receives a request for extradition from another State Party with which it has no extradition treaty, it may consider this Protocol as a legal basis for extradition in respect of such offences.

Cuba will continue to support the legitimate request for extradition presented by the Bolivarian Republic of Venezuela.

Accordingly, a request for extradition based on such an offence may not be refused on these grounds.

It is to be noted that an Extradition request submitted by a non commonwealth country will only be entertained provided that such country has signed an extradition treaty with Seychelles.

The Group recommends that the Democratic Republic of the Congo issue an extradition request in line with international norms.

Review of an extradition request by a high people's court is carried out by a collegial bench of three judges.

The court is required to forward a copy of the extradition request to the person named in it within 10 days of receiving the request from the Supreme People's Court.

Turkey's Justice Minister Bekir Bozdag said later that his government has made a second request for extradition of Gulen to the US.
