E. Situation of the Constitutional Court and the Supreme Electoral Court

Criminal and constitutional complaints up to the level of the Constitutional Court were unsuccessful.

The absence of an independent Constitutional Court and Supreme Court was extremely worrying.

On 19 June 1989, the Constitutional Court dismissed the appeal.

2.8 On 26 May 1997 the Constitutional Court rejected the application.

In such cases, the court will not rule pending a decision by the Constitutional Court within 30 days.

FRANKFURT During the recent hearing on the constitutionality of the European Central Bank s measures to prevent the eurozone from falling apart, Andreas Vosskuhle, President of Germany s Constitutional Court, raised an important question Do non German economists condemn the ECB s outright monetary transactions (OMT) as unequivocally as all but one of the German experts testifying?

To defend its legality in hearings before Germany s Constitutional Court, the ECB itself has argued that the OMT program is a less potent instrument than many believe. Although the German government has been adamant that it is not a German court s role to rule on the legality of ECB instruments, markets have taken note.

Lastly, her application to the Constitutional Court for amparo was also rejected.

The problem is that they could get what they wish for. If the German Constitutional Court imposes limits on the OMT program, the consequences would be dire, for it would render the ECB s guarantee to do whatever it takes ineffective.

This means, secondly, that first elections, and perhaps elections more generally, are not themselves a sufficient guarantee of liberty. As the German constitutional court judge Ernst Wolfgang Böckenförde famously put it, democracies cannot create the conditions of their survival and success.

But, according to the German Constitutional Court, the policy violates European Union treaties a ruling that the European Court of Justice is now reviewing. The ECJ s decision will have important implications for the eurozone s future, for it will define what authority, if any, the ECB has to intervene in a debt crisis.

In his submission on 23 April 2001, the author cited the Constitutional Court ruling of 28 June 1999 to allege that it was not necessary to lodge an amparo application before the Constitutional Court.

Finally, the author instituted amparo proceedings in the Constitutional Court for the protection of her constitutional rights on the grounds of judicial error.

A further appeal to the Constitutional Court was rejected on 12 May 1998.

In a judgement of 9 May 2001, the Constitutional Court rejected the appeal.

2.3 The author applied to the Constitutional Court for amparo, claiming violation of his right to review by a second court.

3.3 The author did not make any application to the Constitutional Court for amparo.

The Supreme Court allegedly totally ignored the Constitutional Court's decision in the author's case.

Earlier this summer, these issues were the subject of two days of hearings before Germany s Constitutional Court, which will issue its ruling shortly. If it finds that the OMT program is inconsistent with the German Constitution, it could force the Bundesbank to withhold its participation.

MUNICH Europe and the world are eagerly awaiting the decision of Germany s Constitutional Court on September 12 regarding the European Stability Mechanism (ESM), the proposed permanent successor to the eurozone s current emergency lender, the European Financial Stability Mechanism. The Court must rule on German plaintiffs claim that legislation to establish the ESM would violate Germany s Grundgesetz (Basic Law).

On 23 April 2001, the author cited the Constitutional Court ruling of 28 June 1999, made two years after the original claim, to allege that it was not necessary to lodge an amparo application before the Constitutional Court.

It followed that the petitioners have exhausted available and effective remedies before the Constitutional Court.

2.5 In its decision of 29 September 1998, the Constitutional Court declared the appeal inadmissible.

He did not even lodge an amparo application on this issue in the Constitutional Court.

She asked whether the Convention could be invoked in the constitutional court or other courts.

When his complaint was rejected at the lower court and appeal levels, the author filed an application for amparo with the Constitutional Court.

The Constitutional Court should also be seen as a remedy, as it was mandated to rule in individual claims that a legal provision violated a constitutional provision.

The ECB statute was not engraved on stone tablets and handed down on Mount Sinai. It is a man made charter, and it should be treated by the German Constitutional Court and others as a living document that is to be interpreted in light of current events.

The Supreme Court recognized that the constitutional protection of freedom of association has a collective aspect.

Furthermore, amendments to the Constitution had granted citizens the right to appeal to the Constitutional Court.

Such decisions shall not be examined on their merits by the courts, including this Constitutional Court .

The author filed an appeal with the Constitutional Court, which was rejected on 25 January 1999.

In August 1998, the author filed a motion for judicial review in the Prague High Court, as well as a complaint in the Constitutional Court.

In Germany, ECB purchases of bonds issued by Greece and other periphery countries are widely thought to constitute monetary financing of profligate governments, in violation of the treaty under which the ECB was established. The German Constitutional Court believes that the OMT scheme exceeds the ECB s mandate, though it has temporarily tossed that political hot potato to the European Court of Justice.

After the results were validated by the Constitutional Court, the Constitution was promulgated on 22 March 2005.

The Court here agreed with the Council's interpretation of the law, both linguistically and on constitutional grounds.
