Illegal trade in ozone depleting substances is controlled by the 1987 Montreal Protocol on Substances that Deplete the Ozone Layer, which aims to gradually reduce and finally phase out all ozone depleting substances.

Illegal international traffic in hazardous substances and dangerous products is a pressing problem for many countries.

The incentive for illegal use of ozone depleting substances arises from the high cost for industry of adaptation or replacement of the machinery used.

(f) All cases of illegal imports and smuggling of ozone depleting substances should be reported to the Ozone Secretariat and dealt with by the Implementation Committee and the Meeting of the Parties.

Information reported by the Parties to the Montreal Protocol on illegal trade in ozone depleting substances (decision XIV 7) By paragraph 7 of decision XIV 7, the Parties to the Montreal Protocol requested the Secretariat to collect any information on illegal trade received from the Parties and to disseminate it to them.

References were made to parallel discussions on the topic in the workshop on illegal trade that had been held on 3 April 2005 in Montreal by the Ozone Secretariat, and it was considered that the report provided useful input for the follow up to decision XVI 33 of the Parties on illegal trade in ozone depleting substances.

The report noted that close cooperation and coordination between national ozone units and customs authorities had proven to be very important for controlling and monitoring imports of ozone depleting substances, and that import licensing systems that had been developed had several positive effects on the reduction of the consumption of ozone depleting substances and on the prevention of illegal imports.
