The Legislative Council (Amendment) Ordinance 2003, which provides the legal basis for the third term Legislative Council elections, also complies with the Basic Law.

The elections for the Palestinian Legislative Council will follow the presidential ballot.

Such reports are bound by law to be laid before the Legislative Council.

Although a member of the Legislative Council and the Executive Council, the Attorney General has no vote in either body.

Except for the appointment, removal and disciplining of officials and the adoption of measures in emergencies, the Chief Executive shall consult the Executive Council before making important policy decisions, introducing bills to the Legislative Council, making subordinate legislation, or dissolving the Legislative Council.

Secondly, the Security Council should refrain, as far as possible, from exercising legislative functions.

Specifically, it provides that the number of directly elected seats in the third term Legislative Council will be increased to 30 (50 per cent of all Legislative Council seats), as prescribed in the Basic Law.

Noting that the Commission of Inquiry into the Constitution appointed at the request of the Legislative Council of St. Helena reported its recommendations in March 1999, and that the Legislative Council is currently considering the recommendations,

Secondly, the Security Council should abstain in every possible way from exercising a legislative role.

On 11 October 2002, following discussions with the independent adviser, the speaker of the Legislative Council announced that the Legislative Council would put proposals for constitutional change before the public to see if they were well supported.

The Basic Law also provides for a mechanism of checks and balances between the executive and legislative authorities. And we need the support and co operation of the Legislative Council before any major financial or legislative proposals can be implemented.
