In the process, the Court has also contributed to the development of principles governing State responsibility.

Uruguay has been involved in the process of the establishment of the Court from the very beginning.

The vast majority of cases are expected to be tried by the Gacaca community court and appeals process.

In order to ensure effective, integrated development, the Court has made a priority of establishing a strategic planning process.

We welcome the Secretary General's suggestion that the important role of the International Court of Justice be reaffirmed and that a process be started to strengthen the work of the Court.

(iv) Ensuring due process of law and the right to be presumed innocent until proven guilty in a court of law

Li Jing, president of the province's Higher People's Court, served as the presiding judge of this case, Wang Jin, chief procurator of the Provincial People's Procuratorate, appeared in court to support the process of indictment.

For example, the Court held an online public hearing on victims and defence issues in the preparation of the Regulations of the Court.6 This hearing allowed wide participation in the process of adopting the Regulations and the Court received responses from all over the world.

The Court is also in the process of replacing its current document management application by a complete electronic document and record management solution.

Such revisions to the process could help to reduce the possibility of one or more potentially negative court decisions that could hamper enforcement efforts.

The Court now has a P 4 post and is also in the process of recruiting for a post at the P 2 level.

Under the Alternative Dispute Resolution Act, parties were encouraged to resolve their differences out of court in order to avoid the costly legal process.

Two transitional institutions, the Truth and Reconciliation Commission, which has just published its report, and the Special Court, have contributed immensely to the peace process.

The author did file a timely substantive appeal with the court, which was only not considered due to the technicality of the lacking process agent.

The Court is in the process of negotiating agreements for cooperation with other international and regional organizations, including the African Union and the European Union.

5.2 The author submits that on hearing his motion to reopen the proceedings, both the Circuit Court and the Supreme Court focused on the distinctions between registry cases and  commercial cases , glossing over the due process issues highlighted by the author.

(a) To observe the evaluation and selection of Supreme Court judges and associate judges in order to confirm that the process is impartial, transparent and credible

Although the process of evaluating and selecting future members of the Court is the exclusive responsibility of Ecuadorians, the Law on the Organization of the Judiciary invites the United Nations, the European Union and the Andean Community to observe the process.

4.5 The State party argues that the complainants could have applied to the Federal Court for a stay of removal until completion of the judicial review process.

This process is particularly challenging for the prosecution, which has several hundred thousands of pages of investigative material in addition to thousands of pages of court documents.

The Appeals Court thus accepted the proposal of the prosecutor to declare the appeal inadmissible for failure to appoint a process agent between the filing of his initial claim on 7 April 1998 and the entry of acquittal by the Misdemeanours Court in 2000.

The operative part of the Order stated as follows The petitioner was informed that he cannot abuse the process of Court and keep filing applications without any basis.

In a three way meeting in May, both Presidents renewed to me their commitment to moving the process forward in accordance with the ruling of the International Court of Justice.

It transpires that, as a result of this process, the Presidium of the Supreme Court reviewed the author's case and ultimately revised his sentence, whereupon he was released from imprisonment.

Both countries were satisfied that the entire legal process to resolve the dispute through the International Court of Justice had taken place in a fair, transparent, responsible and dignified manner.

22. Welcomes the adoption by the States members of the African Union of the protocol establishing an African Court on Human and Peoples' Rights to complement the African Commission on Human and Peoples' Rights, and encourages the finalization of the process leading to the establishment of the Court

The Court also noted that an application under article 34 MAL is not a process designed for purposes of seeking review of a pre existing judicial decision by way of appeal.

Leadership of the reform process has shifted away from the Bonn mandated Judicial Reform Commission to the Supreme Court, the Office of the Attorney General and the Ministry of Justice (MoJ).

Both Presidents renewed their commitment to pursue the peaceful implementation of the ruling of the International Court of Justice and to work together to move the process forward until its completion.

The author himself was responsible for his failure to appoint a process agent or appear before the Appeals Court to explain his failure to do so, and thus for depriving both the Appeals Court as well as the Court of Cassation of the opportunity to engage in merits review of the case, and thus should not be permitted to claim that domestic remedies have been exhausted.

The International Court of Justice has, on several occasions, accepted that this process may be permissible where the parties insert provisions into their treaty which by their terms or nature contemplate evolution.

Meanwhile, the court held that the liability for breach of contract is beyond the scope of ordinary civil agreements, and validity of the agreement should be reviewed in the process of criminal proceeding.

According to the author, the Supreme Court followed its usual practice of not hearing the testimony of any witnesses during the review process, relying solely upon the lower courts' appreciation of the evidence.

It is therefore gratifying to note that the Court has made it a priority to establish a strategic planning process to define its strategic goals on the basis of a five year cycle.

Some foreign regulators such as the Bank of England have agreed not to act preemptively in a resolution process run by the FDIC. E. Situation of the Constitutional Court and the Supreme Electoral Court

Moreover, the Regional Court handed down its judgement in open court.

Clearly, the two main obstacles to the peace process are the construction and continued extension of the wall, which run counter to the advisory opinion of the International Court of Justice of 9 July 2004.

The Court first recalled that Article 35 of the Statute of the Court concerns access to the present Court and not to its predecessor, the Permanent Court of International Justice (PCIJ).

In its public notice, the Supreme Court, instead of defending the judge's decision to debar the author's lawyer, expressed its concern about the effects of the Bar Associations criticism (causing an unjustly suspicious climate discrediting the judiciary both domestically and abroad ), while emphasizing that the trial judge's decision may be cured by a higher court in the legal process .

Disputes concerning discrimination are resolved in court and the court sets redress.

The Circuit Court returned the case to the District Court for reconsideration.
