In paragraph 7 of decision INC 7 1, the Intergovernmental Negotiating Committee requested

(d) Collection, compilation and generation of data needed by the Intergovernmental Negotiating Committee

(h) Other activities necessary to support implementation of decisions taken by the Conference of Plenipotentiaries and the Intergovernmental Negotiating Committee.

This will be followed by a report on the achievements of the Intergovernmental Negotiating Committee since the Conference of Plenipotentiaries adopted the Convention in May 2001.

(a) Preparation and conduct of, reporting on and follow up to the seventh session of the Intergovernmental Negotiating Committee held from 14 to 18 July 2003 in Geneva, Switzerland

The analysis was to be carried out in consultation with the Intergovernmental Negotiating Committee for an International Legally Binding Instrument for Implementing International Action on Certain Persistent Organic Pollutants.

At its seventh session, the Intergovernmental Negotiating Committee, in paragraph 3 of its decision INC 7 1, noted the following programme of work and priorities for the Secretariat for 2005

In paragraph 1 of its decision INC 7 2, the Intergovernmental Negotiating Committee decided to submit theis list to the Conference of Parties for possible consideration at its first meeting.

At the request of the Sixth and Seventh Sessions of the Intergovernmental Negotiating Committee (INC), a country reporting questionnaire was designed and field tested, as part of the reporting mechanism being developed under the Convention.

In response to the above request, the Secretariat prepared a progress report, which was presented to the seventh session of the Intergovernmental Negotiating Committee at its seventh session, in document UNEP POPS INC.7 20.

The target for technical assistance includes those elements of technical assistance needs and priorities noted by the Intergovernmental Negotiating Committee in paragraph 1 of its decision INC 7 8 and contained in the annex to that decision.

At its tenth session the Negotiating Committee took note of the working paper on the preparation and use of focused summaries prepared by the Interim Chemical Review Committee (UNEP FAO PIC INC.10 15) and invited designated national authorities to prepare focused summaries on a voluntary basis using the information at their disposal (see the report of the Intergovernmental Negotiating Committee on the work of its tenth session, UNEP FAO PIC INC.10 24, para.

In keeping with the above mandates, the Executive Director of UNEP convened two sessions of the Intergovernmental Negotiating Committee the sixth session was held from 17 to 21 June 2002 and the seventh from 14 to 18 July 2003.

In response to that request, the Secretariat prepared an initial draft model budget that was distributed on 23 March 2004 to Stockholm Convention focal points, heads of delegation to the seventh session of the Intergovernmental Negotiating Committee and UNEP official points of contact.

Consistent with the budget for 2003 noted by the sixth session of the Intergovernmental Negotiating Committee, as contained in part B of annex VI to the report of the session (document UNEP POPS INC.6 22), the Secretariat completed the following activities

It was prepared by the intergovernmental Aruban Human Rights Committee.

The Secretariat, in cooperation with the World Health Organization, identified for consideration by the Intergovernmental Negotiating Committee at its seventh session a possible initial list of information items needed to assist the Conference of the Parties in evaluating the continued need for DDT for disease vector control.

Consistent with the budget for 2004 approved by the Intergovernmental Negotiating Committee at its seventh session, contained in decision INC 7 1, the text of which may be found in annex I to the report of the session (document UNEP POPS INC.7 28), the Secretariat completed the following activities

Most documents identify the provisions of the Convention, the resolutions of the Conference of Plenipotentiaries or the decisions of the Intergovernmental Negotiating Committee for an International Legally Binding Instrument for Implementing International Action on Certain Persistent Organic Pollutants that provide the mandates for the activities that are discussed in the documents.

The document had resulted from a negotiating process that was neither democratic nor transparent, and that was contrary to the intergovernmental nature of the Organization and the principle of the sovereign equality of States.

Substantive servicing of meetings of intergovernmental and expert bodies and of the Fifth Committee (6)

At its seventh session, the Intergovernmental Negotiating Committee, in paragraph 1 of its decision INC 7 1, approved the staffing table and budget for 2003 and for 2004 2005, contained in annex I to the decision, which is contained in annex I to the report of the session (document UNEP POPS INC.7 28).

Negotiating Group and subsidiary bodies

At its seventh session, the Intergovernmental Negotiating Committee for an Internationally Legally Binding Instrument for Implementing International Action on Certain Persistent Organic Pollutants, in its decision INC 7 9 on the financial mechanism, noted the elements of the terms of reference for the review of the financial mechanism, pursuant to paragraph 8 of Article 13 of the Convention, set forth in paragraph 3 of document UNEP POPS INC.7 24, as amended by the Committee.

Their difficulties range from managing multiple negotiating processes to complexity of rules, as well as assessing particular negotiating scenarios.

The seventh session of the Intergovernmental Negotiating Committee also agreed to submit draft financial rules for the Conference of the Parties, its subsidiary bodies and the Convention Secretariat, which are contained in annex IV to the report of the session, and are submitted to the Conference of the Parties at its first meeting in document UNEP POPS COP.1 28.

At its sixth session, the Intergovernmental Negotiating Committee for an International Legally Binding Instrument for Implementing International Action on Certain Persistent Organic Pollutants , in its decision INC 6 17, requested the Secretariat, in its decision INC 6 17, to begin to address the environmental monitoring and evaluation and monitoring needs as described in Article 16 of the Convention and in doing so to

15. Emphasizes the importance of the intergovernmental nature of the Committee for Programme and Coordination in discharging its functions

The Committee, through its Chairman, will continue to participate in relevant intergovernmental and other conferences and meetings, as necessary.

The Committee highly appreciates the involvement in these meetings of Governments, intergovernmental organizations, United Nations entities and civil society.

Intensive consultations this year have amply proven that in the future we ought perhaps to find a framework for our negotiations that is more stable, more representative, calmer and more conducive to a more dynamic, more effective intergovernmental negotiating process.

They won't move. They're not negotiating.
