Monitoring of the cessation of hostilities and movements of armed groups

International humanitarian law regulates the conduct of hostilities for all parties to an armed conflict.

Hostilities in the area escalated in May with armed exchanges between Hizbollah and the Israel Defense Forces (IDF) and with rocket firing by unidentified armed elements.

The word hostilities should be changed to armed conflict to broaden the scope and to be consistent with amended article 1.

If the effect of armed conflict on treaties remains a vague area of international law, the effect of domestic hostilities on treaties is even more so.

But, in the light of the staggering increase in civil wars , which now make up the vast majority of all armed conflicts in the world, any complete study of the effects of armed conflict on treaties cannot ignore domestic hostilities.

Globally, young people feel that they are extremely vulnerable to armed conflict, whether caused by civil strife, drug wars or ethnic hostilities, the last sometimes being transmitted intergenerationally.

Domestic hostilities

It is well established that armed conflict can have no effect on international humanitarian law (IHL) such as the Geneva and Hague Conventions and Protocols, those treaties dealing with the use of particular weapons and other treaties dealing with aspects of armed conflict since all such treaties were specifically designed to deal with an aspect of armed hostilities.

A fundamental tenet of humanitarian law is that it equally binds all the parties to an armed conflict, and its application is not contingent on the causes or origins of the hostilities.

48. Governments should take all feasible measures to ensure that members of their armed forces who have not attained the age of 18 years do not take direct part in hostilities and that those who have not attained the age of 18 years are not compulsorily recruited into their armed forces.

Thus McNair and Watts point to the fact that a state of war may exist even if no armed force is being employed by the opposing parties and no actual hostilities between them are occurring.

Cash payments for children also tend to reinforce the idea that children are being rewarded for their participation in hostilities while, in reality, the majority of children affected by armed conflict receive very little assistance.

The European Union strongly urges all parties, inside the transitional institutions and outside, to immediately refrain from any further hostilities and armed confrontations, on all fronts, and return to dialogue as the basis for consensus and compromise.

Article 5, paragraph 1, should indicate that the application of certain human rights and environmental law principles during an armed conflict was determined by the relevant lex specialis, namely the law designed to regulate the conduct of hostilities.

However, agreements governing the conduct of hostilities survived, since they were designed for application during war. If this humanitarian exception existed even under the traditional understanding of the effect of armed conflict on treaties, it is even more likely that it exists under the modern approach, which allows for more cases where treaties are unaffected by armed conflict.

Although humanitarian law proscribes terrorism, the fact that such acts are committed during an armed conflict does not alter either the legal status of the hostilities or of the parties involved or the duty of the parties to observe humanitarian law.

During an international armed conflict, it is crucial that States properly determine under applicable humanitarian law treaties the status of all persons who have directly participated in the hostilities and particularly whether they are entitled on capture to prisoner of war (POW) status.

The prohibition of ill treatment in common article 3 also applies in all non international armed conflicts to all persons who do not or no longer actively participate in the hostilities when they are in the hands of a party to the conflict.

It is designed to enable an effective solution to be applied in the field to the humanitarian problem posed by the scourge of explosive remnants of war, which continue to threaten civilian populations in the zones affected by armed conflicts after hostilities have

In that respect, the Rome Statute establishing the International Criminal Court is an effective cornerstone in that it considers it a war crime to recruit or enlist children under the age of 15 years into armed groups or forces, or to actively involve children in hostilities.

An international agreement that, either by express provision or by reason of its nature, is intended to be operative during hostilities is not affected by hostilities involving one or more parties to the agreement.
