The average number of loss types is 3.14 for the claims in this instalment, compared with 2.01 for all claims in the regular category D claims programme, 1.93 for Jordanian claims and 1.71 for Kuwaiti claims.

The average amount claimed for the claims in this instalment is about USD 2 million, compared to about USD 820,000 for all claims, about USD 934,000 for Jordanian claims and about USD 861,000 for Kuwaiti claims in the regular category D claims programme.

Of these claims, the Panel recommends awards of compensation for two claims, while no awards are recommended for the remaining 16 claims.

6.5 The Committee therefore declares that the author's claims under article 14, paragraph 5, are admissible, and turns to consideration of the merits.

The median amount claimed is about USD 470,000 for claims in this instalment, compared with about USD 263,000 for all claims, about USD 335,000 for Jordanian claims and about USD 276,000 for Kuwaiti claims in the regular category D claims programme Approximately 75 per cent of the claims in this instalment contain D8 D9 business losses in relation to unincorporated establishments in Kuwait.

The individual category C and D claims in the thirtieth instalment are claims filed through a late claims programme established by the Governing Council for Palestinians who can demonstrate that they did not have a full and effective opportunity to file claims with the Commission during its filing period for individual claims from 1 January 1992 to 1 January 1996 (the regular filing period for individual claims ).

4.6 The Committee finds the remaining claims raised by the author to be admissible and therefore proceeds to a consideration of the merits of the claims relating to articles 6, 7 10, paragraph 1 9 and 14, paragraph 3 (d), of the Covenant.

The Palestinian Panel subsequently notified the D2 Panel that 14 of the eligible claims, which had already been transferred to the D2 Panel, were in fact ineligible and requested that the D2 Panel take this into consideration in its review of these claims.

This amount is net of USD 162,456.74 relating to withdrawn claims, USD 28,644,101.99 for interest and USD 477,508.68 for claims preparation costs.

With regard to claims for expenses resulting from public health expenditures, Iraq contends that there is no legal basis for such claims.

AUTHORITY TO ACT TEST Pursuant to decision 123, only those claims for which the individual claimant has been found by the D Panels to have authority to act on behalf of the Kuwaiti company are transferred to the Panel for consideration.

Nonetheless, one should note that the courts of the Czech Republic have, ultimately, sought to provide an effective remedy to the authors, in the consideration of their claims.

9.4 The Committee proceeds to a consideration of the merits of the claims relating to the effects of past logging in the Pyhäjärvi, Kirkko outa and Paadarskaidi areas.

The E4 claims population consists of claims submitted by Kuwaiti private sector corporations and entities, other than oil sector and environmental claims, eligible to file claims under the Commission's Claim Forms for Corporations and Other Entities ( Form E ).

The secretariat has also used these electronic searches for duplicate claims in the Palestinian late claims programme, the Bedouin programme and the category A and C late claims programme.

The Palestinian Panel determined that 17 of the 19 claims were eligible for inclusion in the Palestinian late claims programme.

A similar exercise was conducted with respect to category C for the purpose of identifying duplicate claims during claims processing.

As the corporate detainee claims have not been accepted for filing under decision 12, the Panel makes no recommendation of an award for compensation for these claims.

Although the category D Panel (the D' Panel ) began its review of claims in 1996, the first five instalments of category D claims did not include any claims for business losses.

Claims preparation costs A number of category D claimants have made claims for claims preparation costs incurred by them, either in amounts specified on the claim form or in general terms.

With regard to Iraq's contention that some of the claims are for indirect losses, the Claimants state that these claims are not for indirect losses since, by their very nature, they can only be claims of the State.

The fourthsecond group of overlapping claims initially consisted of E4 claims related to 39seven category C claims and 24 category C and D claims.

The awards for these category A claims should be reduced to the amounts appropriate to the proper status of the claims.

Summary of recommended awards for the claims of Jordan ClaimS of the State of Kuwait Overview In the fifth F4 instalment, the Panel reviewed four claims submitted by Kuwait for damage resulting from Iraq's invasion and occupation of Kuwait.

The Panel reviewed approximately 100 claims for D1 (departure) losses and 80 claims for D1 (MPA) losses relating to forced hiding, illegal detention and hostage taking.
